TLDR

British Columbia says it has filed a lawsuit against OpenAI in California over the company's alleged failure to notify law enforcement about threats made on its platform before the Feb. 10 mass shooting at Tumbler Ridge Secondary School. The province is working with the Peace River South school board and says the case raises questions about technology companies' responsibilities when they become aware of credible violent threats. The filing is an allegation in an unresolved legal matter, not a finding of liability.

In a September 21 statement, Attorney General Niki Sharma said the province is working with School District 59 Peace River South as the matter proceeds. The statement does not establish liability, and the province's allegations will be tested through the legal process.

What the province says the case is about

The government says the action concerns whether a technology company that becomes aware of credible threats of serious violence should take steps beyond handling the account on its own platform. Sharma said the province is seeking answers and accountability for people affected by the attack, and described the case as part of its push for stronger national safeguards for AI technologies and online platforms.

The statement also says the province has urged federal ministers to consider Criminal Code changes intended to create what it calls a pathway to human accountability for AI-related actions. That is a policy request, not a change in the law.

An unresolved liability question

The lawsuit puts a difficult question in court: what duty, if any, an AI service owes when it identifies a potentially credible threat outside its service. British Columbia's statement argues that companies offering AI tools to the public should be accountable for harms that can appropriately be traced to their products or practices. OpenAI's responsibility, the facts alleged and any remedy remain matters for the court to decide.

The province says legal proceedings cannot undo the loss experienced by the Tumbler Ridge community. Its filing is the latest effort to seek answers about the events leading up to the shooting while broader debates over platform safety and reporting obligations continue.

The lawsuit says OpenAI flagged 18-year-old Jesse Van Rootselaar’s account for human review in June 2025 over concerns she might be planning violence. Reviewers allegedly recommended contacting police, but leadership instead shut down the account without alerting authorities. Months later, she killed her mother and half-brother, then 6 people at Tumbler Ridge Secondary School. Altman later apologized for not contacting law enforcement. The lawsuit now puts a much bigger question on the table: if an AI company sees a credible threat first, is banning the account really enough? Source: Forbes / Writer: Julie21d
