Whether or not he was goaded into it is largely irrelevant, as the end result is that he performed a premeditated murder. The woman can't be accused of manslaughter or murder, but maybe she can be prosecuted similarly to someone who tries to hire a hitman. Looks like the circumstances of finding her were a bit strange, finding them in the guy's pickup in front of their house dressed in bathrobes, and the guy has a history of being abusive with his wife, and he allegedly suspected her of cheating. It's not so clear-cut as saying he discovered his wife in the process of being raped or anything like that...

The judicial system is well prepared to take care of rapers and often their suffering in jail is much greater than any damage he could have caused and adult woman. Don't get me wrong, rape is a horrible, horrible crime, just not as big as murder. If you were to follow the archaic eye-for-an-eye law, you would sodomize the bastard, but never kill him. And as in any of these stories regarding rape and capital punishment and whatnot, I'll point out that the biggest proof that murder is worse than rape is that in the majority of rapes are not commited through physical dominance, but rather under the threat of death (with a gun and whatnot). And women every time would much much rather be raped than be murdered.

I was probably wrong about the premeditated part, as it seems like there was very little time between discovery and killing, but it's still second degree murder, justified or not. Why shouldn't a woman be able to change her mind once the act starts. What if she suddenly begins to feel uncomfortable or begins to experience pain? I'm afraid the author has an incomplete understanding of the facts. Mr. Roberson actually engaged in a textbook case of household defense. He came home, she and her lover were in his truck. She said her lover was raping her. He got his gun and shot who he had every reason to believe was a home invader. It wasn't an after-the-fact sort of deal where he tracked down this guy and killed him in his home. It was on Roberson's property and Roberson had a reasonable belief the man was attacking his wife.
