Basically creating p2p applications is not illegal but it is illegal to create a p2p network for the express purpose of facilitating illegal activity. So to sum it all up the ruling really just placed marketing restrictions. It also left a vague notion of what the difference is between creating a p2p that is supposed to be used for Linux ISOs etc but get used for pirated movies, games, and software and a p2p application that was created for sharing pirated movies, games, and software.

- KyleGoetz, on 10/12/2007, -0/+0The reason the cigarette companies are still in existance is because tobacco is a huge part of our history and economy. It would shock our economy if tobacco was illegalized like marijuana. This is the same with alcohol.

And yet tobacco makers still make, distribute and market (to some extent) products that contain the words (right on each and every pack)...

So as stated by the surgeon general's warning using this product will kill you.

Somehow, I get this warm and fuzzy feeling that the government really doesn't care about big business and does look after and care for the average joe citizen.

The difference is is that the Supreme Court found that during the discovery phase of the original trial there was a lot of evidence that poitned out that Grokster and StreamCast intended on infringing copyright, indeed, they planned to make money on it and be the next napster. The reason the 9th Circuit agreed with Morpheus was because they read the Sony decision as any legitimate use precludes liability. In this case in the opinion delieved by Souter it becomes clear that while that remains true, if a company is fostering an environment designed for infringmenet they can and should be held liable.
There's a big difference with this and yes everyone's favorite Bit Torrnent, mainly because the makers of BT do so for legitimate non-infringing uses, state that using it for infringement is illegal and do not condone it, and can point to many legitimate uses.
This case keeps the reading of the case strict and to only the MGM case, the opinion only clarifies the reading of the Sony decision so it may be reapplied at the trial part. - eUNKNOWN, on 10/12/2007, -0/+0The funny thing is no one thinks about suing AOL. Last time I checked they still have private rooms run by bots (like IRC) where you can request files.
I still get my DVD (backups) from AOL. The only reason to keep AOL is their e-mail has no limit. So, I request a movie. Over night I get my files.
It will be interesting to see Time Warner VS Timer Warner (AOL) o wait that will never happen because is a double standard. Next time when someone gets shot lets sue the gun maker. Next time some one gets hit by a car lets sue the car maker. Next time and under age kid gets drunk lets sue the beer company.
