Private trackers work because sharing is a requirement, makes for pretty consistent high speeds and creates an incentive to expand the selection available. The users of the private music torrent sites tend to be pretty serious about their music also, I'm not sure why you think otherwise - lots of members dedicate a lot of their time sourcing releases, making lossless copies and recording vinyl to share it with a community that cares. If these sites were wide open standards of quality would drop, people would leech and the almost inevitable response by the law would come about sooner. Widespread availability has never been a good thing when it comes to filesharing, all it does is attract unwelcome attention.

http://www.digitalraider.net - Culyt, on 05/17/2009, -1/+1I managed to get a what.cd invite only to get banned a few days later, I downloaded like 50mb from a few well seeded files (The kind you have basically no chance of ever uploading anything to any other peers let alone a 1:1 ratio) then lost my Internet connection for a few days.
Those sites may be cool but are way to restrictive and elitist. It would be nice if they had some mirror trackers for the general pop with horrible seeds but then many wouldn't bother with the main stuff. They are also a giant target for legal action with being a source of leaks and whatnot. 1:1 ratios aren't really required for BT to work anyway.
