Uploading torrents is no crime. Well, maybe in Iran if you upload pr0n or insults to Allah or in China if it is anything against the party ...
Oh, and calling TPB a host is not entirely right either. It should be clear that they do not host the copyright infringing files. All that is on their site is information where to ask for these files. Prosecuting TPB for that is like accusing the white pages of selling illegal drugs because they have listed the phone number of a drug dealer.

Of course if they have succeeded in bribing the judge the same way they did the police officer on the case then there could be a problem.

- raada, on 08/29/2008, -2/+5The reason it takes so long time is because what TPB is doing is most likely legal in Swedish law. They are not hosting any copyrighted material, they are just saying where you can find files. It is similar to writing a book about how to make explosives (legal) but not actually making explosives (illegal).
RIAA or IFPI or whoever is accusing TPB need to prove that they are doing something illegal, which they aren't doing. So my guess is that this will take very long time and then be thrown out of court. - phoomp, on 08/29/2008, -0/+3I don't think having evidence will really affect the outcome of the case, it would just make it look better when the RIAA buys the verdict it wants. Given how things have been progressing (prosecutors-bought, police department-bought), I don't think it matters that they did nothing wrong according to Swedish law.

Intellectual Property - As it bundles together patent, copyright and trademark laws, all of which are vastly different from each other. It also defines it as property and so implies it should be treated like physical objects are.
Piracy - Piracy was once used as a term against record labels who didn't pay their artists, now it's used as a term against filesharers. It also implies there is something ethically wrong about redistributing the files. I don't think there's anything wrong with redistributing the files as long as the author receives a small donation (which is hard to do with the huge record labels and easier shown in free software).
Copyright 'protection' - Copyright was first implemented in the public's best interests, so that the author would be able to continue writing and so more works would be available to the public. However, copyright was only intended as an industrial regulation (since if one tried to copy a book without a printing press, the impact would be negligible). Now, however, copyright does not protect the public's rights but restricts them so please refer to it as copyright restriction. IMO copyright needs to be re-though in the modern era, when anyone can copy a book or album, since it requires draconian laws and methods which invade people's privacy.
I think that the best system would be an iPhone app store style application but where everything is free to download and redistribute (perhaps under the GPL) but it is very easy to donate directly to the author/band/developers so the only thing stopping people from donating would be worrying about the few dollars and not the huge hassle of signing up in the first place. - HotSaucePanCake, on 08/29/2008, -0/+3I wonder if they realize drawing attention to TPB is just making their situation worse... How can they both have lost money.. if the one is just the Swedish version of the American association distributing American music and movies etc. I can't sue someone twice for a singular act.. surely?
