Suspending the kid for speaking another foreign language, especially when it was in the form of idle conversation, is just ridiculous, but his dad, who is now pushing for a lawsuit over this incident, is absolutely ludacris.
Just to prove my fact, when he was asked why he decided to launch the civil suit, his response was:
Said Rubio: "I'm mainly doing this for other Mexican families, where the legal status is kind of shaky and they are afraid to speak up. Punished for speaking Spanish? Somebody has to stand up and say: This is wrong."

If it doesn't effect me or anyone else, then you can do whatever you want, be it speaking Spanish or smoking crack, more power to you.
Everyone needs to learn to stop pushing there beliefs and way of life upon others, and stay out other peoples business. - locolobo, on 10/12/2007, -0/+0Submitting it, I didn't mean to imply that immigrants shouldn't speak English to, I think it's their responsibility to learn our country's language to make their own lives more convienient. HOWEVER, the suspension of a student for simply speaking a spanish phrase in school is ridiculous, and AGAINST constitutional law.

The problem is that there was NO written policy banning conversing in another language at the school; therefore, the warnings and initial punishment was not justified. - rekrapt, on 10/12/2007, -0/+0This doesn't sound like a brazen refusal to comply with the school's language policy. - Tweidle, on 10/12/2007, -0/+0I can see this from both sides. Yeah the kid was talking to another kid about a dollar, big deal. But if the Teacher doesn't speak Spanish they could be saying anything. This rule is no doubt in place for the protection of the teachers.
