The rootkit is installed during the process of accepting the Sony BMG player which they require one to use to access the music on their discs via a PC. If they don't change things real quick I won't be buying a PS3. It'll hurt but I'll stick to my guns. I understand the best way to 'vote' in america is to vote with your dollars.
The list for why the Sony DRM is bad is growing every hour:
1. Huge security problem.
2. Deceptive EULA.
3. Spyware (it phones home).
4. Copyright protection software that violates copyright.
5. Since it is covered under DCMA, it technically illegal to even detect it.

Who says it louder that the customer is a thief by putting those things into our PCs.
They so forget that we,the customers are the ones that give them the money to build their empires and instead they point a gun to us,with their stupid rootkit software and whatever they've got,insulting us.

Phew, that explains that. So this really has nothing to do with the rootkit, they just copied parts of player into their own media player. If so the license Sony has with this other company is sure to indemnify them from any legal responsibility. It is the original creator of the DRM that will be crushed by this, though the negative PR storm is sure not going to help Sony any.

The first step in a case like this would be to bring the violation to Sony's attention and allow them to get into compliance. No harm, no foul. Since they didn't actually charge for the software (you got the DRM for free when you bought the CD) they can't really sue Sony for a share of the revenue gain.

...Sounds like you've never compared an 80kbps to an 80kbps Vorbis ;). Try it - you'll be impressed. ATRAC is rather ghey, and it's a dead format because Sony would never let anyone use it without arse-mining them for $$$. It's the Sony way. ATRAC doesn't come close to Vorbis anyway. I just figured Sony would use ATRAC over MP3 because they enjoy inventing hexagonal wheels. - shovel10, on 10/12/2007, -0/+0so basically they stole software and silently illegal put it on user computers. Didn't report, denied it, refrused to remove it, pretended to remove it, insulted their customers as not relevant, brought out a patch that data-mines the customers that even want to go through the hassle of removing the patch while their great patch crashed and ***** up the computer meanwhile. Also taking their malware out of the stores when EMI did it before is not an option. Sony F#*#$K yourself.

Regarding the question of who would sue Sony, I'm sure whoever it is would get some financial support from Sony's competitors via back channels and non-profits.
