For years, the RIAA has painted with a wide brush and used extortionist tactics bleed proportionally massive settlements out of people who can't afford a legal defense. It seems that in recent months, the backlash in public opinion has begun to materialize into potentially damaging defenses and counter suits. Here's where things to terribly awry.
I have a feeling that we're walking into a no-win situation. If the defenses largely fail and the counter suits fall flat, the RIAA's tactics become legally validated and nothing short of legislation will stop their onslaught. If the defenses and counter suits succeed, the RIAA will start arguing that the cases they've lost put them in a position where they can't gather sufficient evidence to prosecute cases without certain powers historically reserved for law enforcement. They'll lobby for those powers -- or at least something close -- and end up in a better position to preserve their flailing business model than ever before. In other words, even if we win, we lose.

People, if you don't go to target or walmart and buy that new Jessica Simpson CD, and the things just stagnate on the shelves, then the retailers will get angry at the record companies and the record companies will have to continually pay out for shipping costs and distribution. And if nothing still gets sold, then they'll really start crying about their profits. And that's when they'll have to change or their business will die.

It's because they get sued ALL THE TIME. I mean, this is not as simple as a Law and Order case, because the only evidence involved is the internet, and they can't get a warrant or something similar legally (unlike normal crime cases where evidence somewhere else can be dug up and in turn generate a search warrant)

I think you miss the point entirely, the RIAA breaks the law all the time, to illegally search and spy on everyone, not just people they believe are stealing. Would you like your government coming and and searching your house with out a search warrant. Now take that scale and apply it to thousands of houses. Sure you are going to find people who are sharing but it still is an illegal breach of our privacy. In no way should they allowed to proceed with these blanket investigations that they currently are using. The whole "pirates kill an artist's success" argument is unfound on the simple basis that piracy is not the only factor, and a factor that is not easily determinable in its impact alone, that can cause failure.

Let me add to what I've said above. First off, whether you think file-sharing is right or wrong is your own opinion, but what the RIAA is doing to fight it is wrong (see above). Second, small artists aren't kept from making it big because people are downloading their music, it's because the record companies aren't investing the money in these artists that they are in those that have already made it. Downloading their music would actually make them more popular. More exposure. Third, like I said above, what they're doing is NOT right. At least the tactics, anyways. And finally, you'd still be paying a fine. And anyways, the RIAA could care less about the artists. They just want money. Artists make very little money from selling CDs. They're making even less now that legal downloading methods have reduced the price of music (the reduced price is a good thing tho, IMHO). Artists make nearly all their money from concerts, t-shirts, and other merchandise. You are just an ignorant fool. That's one of the reasons that they haven't already been stopped, there aren't enough people willing to take them on - yet. I reckon its only a matter of time before the RIAA all just collapses.

If the RIAA settled in this case, they would avoid setting the legal precedent that they engage in unscrupulous investigatory tactics.
