- mCanada, on 07/16/2008, -1/+16One issue with the "making available argument" is that bittorrent data isn't sequentially distributed like with ftp or http. IE. 1,2,3,3 is sent to the user. With BT you might send piece 1,5, and 10 to a certain user. Those three "chunks" might not constitute enough for copyright infringement and if they do how much does say 3/10's of a video game or .3119% (spread across the file) an mp3 really infringe? Hell if the file wasn't complete it could simply be noise (fair use maybe??). If more than one person was "making available" I would put forth that you would have to break down how much each user was "making available" percentage wise, especially if you were making monetary damages. Especially since they count the number of songs infringing. Hopefully if this is the case, this would tie up the process
- tomz17, on 07/16/2008, -0/+11At which point does something become copyrightable? A single bit? Obviously not. 15 bits? 76 bits? or is it the interpretation of those bits? and... by extension... how far does something have to deviate from its original form before copyright no longer applies?
Which leads to an even more interesting question that my brother posed a while back.
What if I ran a website with "copyrighted content", but all of it was utterly corrupted by random noise to the point of being completely unusable. (For example, let's say I rar'd an MP3 and then messed up the rar file with random noise.) Am I distributing copyright content? Or is it just garbage? It's functionally worthless. You can't play it, and it's certainly not even recognizable as the original work. At which point does it cease being a copyrighted work?

What if you ran a website with parity information that allowed you to recover the corrupted files? Are you distributing copyrighted content? Alone, it's worthless. In fact, it's new content that you generated yourself. It's also not recognizable as the original work... It's also completely worthless on its own ???
Both of us are distributing data that is functionally worthless and AFAIK not a copyrighted work. The intent to pirate stuff is definitely there, but are either of us breaking the letter of the law? How about if we work together? How about if we work separately?
Things to ponder, and AFAIK not yet challenged in our legal system.... and please do feel free to chime in if you have any insight into the legal answers - Shogi, on 07/16/2008, -0/+9***** asinine. They'll do whatever they can to sue whoever, regardless of whether it's true or not.

It's like imposing the death penalty on petty thievery, people would stop in a heartbeat. I used to think this as well.
