For one thing, H.A. Stern the personality would not be suing in a business matter in his own name, but rather through a proxy like "One Twelve Productions". For another the personality does not facilitate Ad-Sense, but the realtor does.

If there is a contract in place, any clicked links above and beyond the "negotiated amount" should just be written off by Google. It is up to Google to stop serving the ads, not for the small company paying for the ad space to just pay for any extra links served. - inactive, on 10/12/2007, -0/+1stevec, how does that not make sense? If google handles a million searches a day for "Britney Spears" that means they serve the ads related to Britney Spears a million times a day, or about 12 times per second. Now, if your budget allots for 100 clicks and you're at 99, and they serve your ad 120 times in the next 10 seconds, maybe only 1 of those people will click your add, or maybe all 120 people. Since those clicks could occur 1 second after they serve your add or 2 hours after, it is hard to predict with perfect accuracy how many times your ad will be clicked. but anyway, your ad campaign can go seriously overbudget when this happens.

Hmm interesting. Well he's been #1 in radio in every market he's in for almost 20 years so i guess lots of people like his style, of course he doesnt rely on fart jokes or fake breasts and those less fortunate people on his show are paid and he gets them showbiz jobs, he doesnt exploit them like you seem to think he takes care of them and gives them jobs they otherwise would never have. Just because you dont like his style of humor doesnt mean he is worthless, he employees tons of people and he is a pioneer in sattelite radio and on demand tv, wait and see. - inactive, on 10/12/2007, -0/+1There is a contract - you agree that if your ad is overserved by less than 20%, you will pay for the extra ads. If you have a strict budget and can't afford the extra 20%, you should be taking that into account when setting your google ad budget and set the budget lower than what you really want. But the bottom line is that there is full disclosure and the 120% thing is featured prominently - there is no way you could be creating a campaign and not know that risk exists. It's not hidden in some 5 million word user agreement.

Don't worry - the Google backlash will soon come. In less than ten years, their business/dominance of internet archiving will be akin to Microsoft's dominance of the PC Market. Nobody will, or should be, cool with that. Tbe the world's #1 archive of information will be in the hands of one for-profit corporation, archiving everything from literature (Google determining with literature to archive? Which authors/subject matter? HELP!) to photographs to medical texts to personal information.
Google's image of the 'little guys that did good' is suitable for the 1999 Google. Make no mistake - Google is a behemoth of a company, worth over $80 BILLION DOLLARS (http://news.bbc.co.uk/1/hi/business/4072772.stm). How much of an overcharge could we really be talking about? and Howard Stern or whomever posted the ads got extra clickthroughs so it is not like they were being robbed! Filing suit seems like a lot more work than just calling Google and requesting a refund for the overage - if it was really more than 120% of their agreed budget then Google would have refunded it.

They serve tons and tons of ad impressions and if an ad is more succesful than expected (has a higher ratio of clicks to impressions) then it's very easy for more clicks to end up occuring than Google intended. On the other hand, if they overserve you one day they should be trying to counterbalance the next day so that overall monthly budget remains right on.

While I haven't really seen any evidence to support this claim there isn't really anything to deny it either. Anyone find anything concrete on this? One guy sued an R/V company cause he had "thought" that the cruise control meant it would drive with out him at the seat. He walked away with cruise control on and went to make coffee. He had a wreck and sued for a million and WON.
