Suddenly, the government decides that regulation on the porn industry is not strong enough to protect kids, and comes crashing down on you.

I think especially golden was the thread(s?) about them trying to take down Rip Productions (they link to tons of ripped material, as per the site's name) and failing in the end, and then *that* web master coming there to rile them up with talk about being "untouchable" to them. umm... I guess you had to be there.

Catch is that the companies making the accusations usually have a large, well-paid legal team.

Spamming DMCA notices via automated mailers? That's even MORE illegal. And to boot, sending fake takedowns(such as the one for fake child porn) is SO much more against the law. And lately, more and more attention is being drawn to that OTHER part of the DMCA that states that intentionally filing a false takedown notice is a federal offense. While this, unfortunately, has not been used too often, you can bet your ass some torrent site owners would sure like to give it a whirl.
The US Embassy in Sweden tried and failed. Their still trying. 500 000 emails or letters with these takedowns won't change anything.
DirectNic is a domain name registrar. Not an ISP. TPD hosts their own content. They could issue DirectNic a takedown notice, DirectNic will laugh at them and point them to the actual web host(TPB). If DirectNIC does take it down, TPB can easily get another domain and point it again. Simple. Then once DirectNic releases the name, rebuy it with another registrar.
