Any day now. Any day... - MovieSnobs, on 10/12/2007, -0/+13I actually testified in this case, on behalf of the ISP I work for. They didn't tell us (during the case), what the charges were, but the FBI called me late Friday night (1/12) after the verdict came in, to tell me.
I had no idea it was the first conviction of anti-spam in the US, I feel pretty good to have been a part of it.

I hate spam as much as anyone, but it seems that a monetary fine would do more good for all of us than a ridiculous, life ruining prison term, which does us next to no good (I doubt anyone is going to stop spamming for fear of a life sentence...simply because the idea of getting a life sentence for anonymous, impersonal crime is incomprehensible).
I think some prison is good, but 101 years is insane. He should be fined into oblivion, and given, say, 10 years (seriously, 1 year would be enough for anyone to regret what they were doing), but 101 years doesn't do anyone any good. It's not like he needs to be kept of the damned streets or something. Also, it's got to be easier to convict and sentence more people if the sentence is lighter, right? So a shorter prison term plus some sort of incredible financial ruination would be more easily applied to more spammers, thus actually discouraging folks from spamming. If you're worried about repeat offenses, just Mitnickize him, make sure he doesn't touch a keyboard.
Remember: prison is ineffective punishment, expensive for society, and profitable for the prison industry only.
edit: yes I know he was phishing. I know that is much worse. But it is still nonviolent crime for financial gain, and I don't think that prison term is an effect deterrent or an appropriate punishment. - theghoul, on 10/12/2007, -0/+2Where's my $69 copy of Office 2007 professional?

What if he's part of some underground crime network and they pay it off (unlikely but yeah) eh? He won't learn anything if someone pays off his sentence, forcing him to go to prison ensures that he'll have to think long and hard about how bad the stuff he did was. While I'd agree that even though 101 years for a phisher is slightly excessive we don't know all the facts, for all we know he could've ruined 50 lives by financially draining them.
I'm fairly sure 10+ years and whatever punishment comes with robbing a bank would be more appropriate, but I'm sure the judge knows what he's doing (excessive punishment first, appeal, reduced to something less yet still excessive.) - michelbites, on 10/12/2007, -1/+1GOOD!

Why has it taken so bloody long to catch and convict ONE person? The Feds are taking way too long to catch and convict phishers and spammers. If they offered rewards to hackers for taking down these guys, I'll bet there'd be a long line of guys waiting to be tried in no time. They're just not working hard enough to catch these crooks.
