I wish the artists themselves would step up and defend their own promotion. Promotion = sales to appropriate listeners. YouTube is a veritable wealth of free promotion for musicians and it should be embraced by both the performers and the labels, as well as the public.
I am a published musician and still I say:

Old media is indeed dead, and a new model of distribution needs to rise out of the ashes, and unfortunately it can't happen until the people that are completely set in thier ways go the way of the dinosaurs.

20 years ago I was deeply involved in the music industry on the retail end (and in radio). Do you know what the big issue was? Pay for play...payola. Those that paid to get play were BREAKING THE LAW. There was a big scene about this in all the industry rags and it was good conversation for many.

ASCAP is trying to make ringtones a public performance so they can steal peoples money. If you play FM radio in your shop and other people beside you hear it you now owe ASCAP money. If you drive with the windows down and someone can hear your music outside the car you owe ASCAP more ***** money. This is ***** so let me repeat my first statement ***** ASCAP/RIAA/MPAA!

A blog using it to show a video with music if blog has advertising should be sued because they are making money off of someone's else work.. If blog is just personal with no income, then it should be fair use.. simple as that.. even though I'm sure I'd get dugg down just because part of my logic defends the ASCAP because everyone believes they are entitled to get everything for free.. I mean originally the pirates were pirating songs because the music industry was forcing people to buy the whole album, then the music industry gets that fixed and they still cry for free stuff.. It's like running a red light, if a cop pulls you over and writes you a ticket you shouldn't get mad at the cop because you were the idiot who ran the red light.

Ascap seems to have time enough to police the internet for Youtube videos. Why don't they simply ask Google to remove the infringing videos instead of harassing people who embed them in good faith? Not true. Back in the late 90s this policy was changed. The store has to be larger than a certain square footage.

The amendment law applies only to performances by means of radio-over-speakers or televisions, only if no direct charge is made to see or hear the performances, only if the performances are not further transmitted beyond the establishment where they are received, and only if the original transmission is licensed by the copyright owners -- that is, the radio or television station, cable system or satellite carrier is licensed by the copyright owners or their performing rights organizations.
