However in this case I don't think it would be warranted unless they wanted to be *****. I don't think the Digg crew would be stupid enough to shut this one down. If DigPics became massive and Digg.com thought it was cutting into their revenue even after their official pic section came up.....I could see them getting upset about it.

I use a site that used to be called "diggfeed". The owner had to change the name. (it's now piggfeed). i don't know if one less "g" in the name will make a difference, but the look of the site and the logo font is the same.
