- DarthDaddy, on 10/12/2007, -0/+6Anyone remember that kid with the name Mike Row? He made a site called mikerowsoft.com and got into trouble with Billy.
- jkendel, on 10/12/2007, -0/+6i wish my full name was Orac leapplecisco.....
- snorkle256, on 10/12/2007, -1/+6I don't think Dell has much of a chance of winning this. ;)
I'm sure Dell will win. - jinexile, on 10/12/2007, -0/+3DarthDaddy, actually Microsoft gave Mike Row cash + gifts in exchange for taking down the website after public pressure mounted against them.
Dell computers is based on the last name of it's founder.
Dell websites is as well.
I don't think Dell has much of a chance of winning this. ;) - dynein, on 10/12/2007, -0/+3take it from a trademark lawyer, all of you people opining that "dell doesn't have a case" don't know what you're talking about. you should preface your comments with "_i think_ that dell shouldn't be able to do this." because, seriously, your statements are as laughable as "five plus five equals seventeen!!" a man named jim dell can't start selling computer related services using his last name. a man named jim mcdonald cant start selling hamburgers using his last name. a man named jim goodyear cant start a tire company called jim goodyear tires. think about it a little bit.

For those that doubt something like this is possible... - joeyjojo, on 10/12/2007, -1/+3"I hope you all take a second to realize that Paul Dell is a fraud. Dell is not going to sue him. They don't even care that he exists. If they had any interest in his site they would have sent him a cease and desist letter first. Paul Dell is just making a story up to get people to donate money to him. He knew a story like this would gain interest on digg and it looks like he was right. I hope none of you actually gave him any money. If you did you might want to call pay-pal and get it back. I hate frauds and I hate when people fall into there *****."
Paul isn't a fraud. He's a web designer. Quite active on several forums. Dell did send him cease and decists 3 years ago. Paul said no. Dell dropped it.
"I understand Dell's (the company) point of view and Paul Dell is not exactly a great web designer so I don't give a crap. "
You don't give a crap that our copyright and trademark laws in this country are increasingly designed for the sole benefit of large corporations?
"".... The system is designed to protect the rich."
that's completely wrong, bucko. the "system" is designed to protect the consumer."
The IP laws in this country were originally designed to protect and benefit us...the citizens of this country.
That's not so anymore. They are mainly to protect the large corporations.
"it's you, the consumer, who is harmed by trademark infringement. if any 2-bit-shyster was allowed to sell computer-related products under the name "dell" or "gateway," people would be fooled into thinking they were getting a quality of goods that they were not in fact receiving."
That would be the case if this person was, indeed, selling computers. Using the name Dell. With a trade dress that looked like Dell. In this country.
But that is not the case.
Also, this is not a scam, and he's not begging for donation. Give if you want. Many folks have asked him to stick with it and put up a bit of a fight. As such, they are the ones pushing for the donations.
Honestly, he probably doesnt' have much of a chance. Dell has lots of lawyers. In the end, he with the most lawyers tends to win. Just said that citizens can't own their own names anymore. - Kamaji, on 10/12/2007, -0/+2What's next?
Are they going to try to claim legal right to the Wisconsin Dells too? - tpwiz4, on 10/12/2007, -0/+1There will probably just be a settlement.
- lowrydr310, on 10/12/2007, -0/+1You never know... Go look at Nissan.com and see how messy things can get.
- jeolmeun, on 10/12/2007, -0/+1"i wish my full name was Orac leapplecisco....."
http://www.google.com/search?hl=en&q=legal+name+change - ohcoaster, on 10/12/2007, -0/+1oh man i'm getting sued too! my last name is Ibm and i have a site called ibm-manure.com that sells manure. Please send donations to paypal account number...
- domr, on 10/12/2007, -0/+1I'd be more sympathetic if Mr Dell wasn't begging for donations.
Also, the Register article is over a year old! - dongiaconia, on 10/12/2007, -0/+1Way to go Dell! I was begining to wonder who the next Digg Boycott Mascott was going to be...
- fo0L, on 10/12/2007, -0/+1Sounds like a scam to me...
- peteresch, on 10/12/2007, -0/+1I would send Dell Inc. a letter saying they can have the domain name on two conditions:
1) The purchase of a new domain chosen by Paul Dell
2) A link on the dellwebsites.com homepage saying "If you are looking for Paul Dell click here." - jeolmeun, on 10/12/2007, -0/+1"i dont understand why these rich ***** keep suing innocents. don't they have anything better to do?"
"WTF? He designs websites but his fundraising page is a lame default Blogger page?"
"This is a blog created by friends of Paul Dell. " - moracity, on 10/12/2007, -0/+1Looks bogus to me.Scam trying to get money. Not a mention of any of this on dellwebsites.com.
Anyone have evidence that Dell is actually suing this guy? - smeager, on 10/12/2007, -0/+1Article from The Register about this http://www.theregister.co.uk/2005/01/26/dell_domain_dispute/ . Happy reading.
- blasphemer, on 10/12/2007, -0/+1Sniff, Sniff....Smells like fraud to me
- FishyJoe, on 10/12/2007, -0/+1There is something called prior art. Really the only way this guy has any kind of case is if he was using the name before Dell for his web design business before Dell started his computer business. Otherwise he is toast.
- CosmicJustice, on 10/12/2007, -0/+1The guy doesn't have a prayer. This is long settled case law. Just because your last name is McDonald doesn't mean you can open your own McDonald's Restaurant.
- cptpike, on 10/12/2007, -0/+1I'm not sure I would say they don't have a chance. Take for instance Nissan.com. Uzi Nissan has been running his small computer company for over 20 years. He has also had nissan.com since 1994. Nissan Motor Corp. has tried for several years to take nissan.com. Running Uzi Nissan through the proverbial legal meat grinder. This kinda of stuff really ticks me off. Check it out here: http://www.nissan.com/Digest/The_Story.php
- NegroSuave, on 10/12/2007, -0/+1It would be infringement if Dell can prove that they were a recognized brand before Paul Dell began using his business. Of course unless Paul incoporated himself it makes it hard to prove when the company was formed. If they reference the case of Nissan Computers v Nissan Motors there is a precedent and Paul could have a case.
Dell however registered its wesite in 1988 Dellwebsites was registered in 2001... Dell was already a name by then so Paul has little leg to stand on in an infringement case. - Juvenall, on 10/12/2007, -0/+1Dell has a perfectly legit case here. Since Dell does more than just computers and has been working in the industry under that name since 1988, a site called "dellwebsites.com" very well could be seen by a normal person as a Dell branded service.
This is the same reason you cannot open a restaurant called McDonald's, even if it's your last name.
Dell2win, no digg. - sithvicious, on 10/12/2007, -0/+1he also cant ask Dell for anything in exchange for the domain. a little thing called cybersquatting does not permit him to do so. If he wants to give them his domain he has to do it for free.
- tellman, on 10/12/2007, -0/+1looks like a scheme.
- crankydoodle, on 10/12/2007, -0/+1Like it or not, the "system" that is currently in place requires companies to protect their brand(s), trademarks, etc. from dilution by any means... which is (generally) the primary reason that companies do things like this. I, personally, don't agree with it, but what with the state of copyright/trademark issues, it's the norm. Sad, but true.
- dynein, on 10/12/2007, -1/+2".... The system is designed to protect the rich."
that's completely wrong, bucko. the "system" is designed to protect the consumer. it's you, the consumer, who is harmed by trademark infringement. if any 2-bit-shyster was allowed to sell computer-related products under the name "dell" or "gateway," people would be fooled into thinking they were getting a quality of goods that they were not in fact receiving. - katsuey, on 10/12/2007, -0/+1It's not a scam and the blog was created by FRIENDS of Paul Dell. I'm interested in the suit because my last name is "Brown". Now if I buy a domain name like "BrownWebSites.com" does that mean UPS can come after me?
There is no illusion at dellwebsites.com that it is in any way connected with Dell. It's logo is not similar, it's colors are not similar and nothing would make a thinking person think they are at a web site by Dell, Inc.
You don't have to like Paul Dell's work (though I see nothing "wrong" with it) to want to help the guy. This is about intellectual property rights and about giants bullying the small guy. - h4lofourt33n, on 10/12/2007, -0/+0This is just sad, does Dell really need money that bad? Come the ***** on!
- realchris, on 10/12/2007, -0/+0It's like when i first heard about million dollar homepage. Why didn't i think of that first... Although it will suck for him (them) when dell really does sue.
- rmkBow, on 10/12/2007, -0/+0another one of these? i guess it sucks to have a name similar to a corportate giant.
Mike Rowe was lucky getting compensated for losing his domain.
only this dellwebsite, doesnt quite make sense why its being attacked considering dell doesnt even sell websites or anything like that. - blasphemer, on 10/12/2007, -0/+0Some guy actually said the word "bucko" in his post...
AHAHAHAHAH - ArchAngel21x, on 10/12/2007, -0/+0Just link directly to the page instead of linking to a BLog entry with the link to the page. That is annoying.
- inactive, on 10/12/2007, -0/+0WTF?? Paul Dell should countersue DELL Computers, because dell computers suck ass and they are tarnishing HIS good name
- cmg2005, on 10/12/2007, -0/+0Dooood...... you're gettin a Dell.....
- DuneAdx, on 10/12/2007, -0/+0Why are these companies waiting for other peope to register the sites with their names in them? If Dell wasn't run by idiots, they would have bought up every Dell name they could think of. I mean it's like two bucks or something from GoDaddy.com.
- inactive, on 10/12/2007, -0/+0Ok, Dell's on my ***** list.
- Pplus, on 10/12/2007, -0/+0Independent of how I feel about Dell doing this, how about linking to a site that explains some of the background of the story? I don't want to be automatically linked to this guy's fund-raising site. If I want to donate, I would go to his site after reading a decent story and donate. I don't like that the poster is deciding Dell is bad for me...
- thenativeraver, on 10/12/2007, -0/+0http://digg.com/technology/Giant_Dell_Computer_Corp_harrass_Paul_Dell_for_DellWebSites.com
DUPE!!
submitted by danswhc 2 days ago - joeyjojo, on 10/12/2007, -0/+0er...just SAD that...
- reets, on 10/12/2007, -0/+0I agree with JShope, just adding a notice saying the page is not related would have been the easiest thing to do. I have done that in the past with my sites and programs I create and no problems.
Dell Computers suck hardcore anyways so how can they say Paul is hurting them? Dell Computers hurts itself every time it sells another computer (just another person with their eyes opened). - mouthster, on 10/12/2007, -1/+1His website sucks, he should lose.
- inkswamp, on 10/12/2007, -0/+0Yet another in the very long list of reasons to avoid doing business with Dell.
- msva124, on 10/12/2007, -0/+0This guy hasn't made a good faith effort to prove he is not a scammer. See my comments at the bottom:
http://www.dailytech.com/article.aspx?newsid=918 - cstmoore, on 10/12/2007, -0/+0This reminds me of the "Gateway 2000" case from 1997....
http://www.computerworld.com/printthis/1997/0,4814,21770,00.html - JShope, on 10/12/2007, -0/+0This could be handled so much better by just asking the guy to put something on his website stating that he is not Dell Computers. It would be better advertising for Dell, and it would avoid the money drain that this lawsuit will cause.
BTW - Do I have to pay royalties if I sing "The Farmer in the Dell" with my kids? - inactive, on 10/12/2007, -0/+0This is ridiculous. I'm sicked that any corporation would attack a little guy like this. Why do they think they're the bees knees every second?
- eN1X, on 10/12/2007, -0/+0I have always hated Dell and now I hate them even more! They can never get away with this...
