BTW, there were a select few, like myself, that literally said, "well, it was a fun year of playing free games, time to pay $400 for a new machine and get back on Xbox Live." I modded mine, got banned, and I deserved every bit of it! I'll just play my games offline without issue, and buy a new box for playing Xbox Live! ... which in my opinion, is the REASON to have an Xbox360.

I am a lawyer, and I go up against larger opponents every day of my professional life. No lawyer is going to invite a lawsuit if he or she thinks that his or her practice will be harmed by it.
In this case, my only "client" would be myself. But I have spent enough time in court to be able to spot a bluff when I see it. Microsoft is not going to sue me or anyone else, for that matter. Which is exactly the point of our "Sue me first, Microsoft" campaign. If they believed that they had a good case, they would have done what NTP did to RIM (the Blackberry maker), they would have asked the court to shut down the operations for any company that was really violating their patents. Microsoft is hoping that potential users of Free Open Source Software will engage in self-censorship. We are just saying that we are not going to engage in self-censorship; and that we would like other potential users of Free Open Source Software to know that they are safe, too.

Patent details are freely available online, are they not? Let's face it, Microsoft isn't going to sue anyone. They don't care about end users. Their goal is to approach small or mid-size businesses and scare them into paying licensing fees for using Linux. They won't dare go after a large corporation with a patent portfolio that rivals their own. They're going to go after the easy targets. Smaller companies that cannot afford to wage a drawn out legal battle, but have enough in their coffers to pay out a small licensing fee per year.

All of us in the Digital Tipping Point project use various flavors of GNU Linux. I personally have boxes running SuSE 10.2, Edgy Ubuntu, and Mepis. I also volunteer as a level one tech support guy at a public middle school in San Francisco that uses LTSP to run 33 thin clients. Pluse we have another 30 fat clients in the school running Mepis. One of our sys admins, Adam Doxtater, is the founder of Mad Penguin.org, and Slackersbible.org. You could go to Madpenguin.org and search for Linux reviews by Adam.

Whatever you think of Microsoft or GNU Linux, the fact that this is on Digg's front page means it was a smart thing to do, end of story. Microsoft has lots of money to spread its propaganda (ooops....marketing message) about the nature of the company and what it believes to be ethical and fair. Most of the Linux community don't have such resources. By doing things like this Linux activists get collective publicity and compete for air space. Just keep the arguments coming, and probably the more personal attacks on Einfeldt the better, that will keep the story up the lists and some mainstream journo might take it up.

The author new that anything relating to the 'MS patent claims', stands a very strong chance of making it to Diggs front page. It doesn't matter how lame the stories are, the title just needs to include the words "Microsoft FUD", "Patent" and "Linux", it's an almost guaranteed traffic generator. Patents were started to protect individual inventors, the small guys with good and innovative ideas, from being exploited by larger financially powerful interests. Now the system is so badly broken particularly in the US, it serves to keep lawyers in business and to provide risk to any individual with a good idea that does not have massive financial backing. Reform is long overdue but I suspect that a political system so heavily geared to existing financial interests is not likely to go down that route.
