They're presiding over the laws of the nation and choosing sentences that affect peoples lives. The outcome of the case can also have repercussions for future cases (precedents etc). This wasn't a random traffic violation, it was a pretty big 3 part John Gotti mob trial. Playing Solitare is a display of apathy (of "sheer boredom" as another poster said above), which wouldn't make me feel too good if it were my trial.

Read it again, the word order was a bit bad, but this was the actual judge of the trial. They used "he" too often, and it becomes confusing.

Now the fact that the witness is playing solitaire, does that make it less trustworthy ? He should be told off but recusing him, that's a joke !!!

When I was a little kid (oh crap that was a long time ago) we toured the local courthouse, and guess what? Every single courtroom had playing cards on the Judge's desk. The comment from the tourguide is that trials aren't as interesting as one might be led to believe, and after a couple of trials Judges get REALLY bored. Even in cases where the Judge might miss something followed by an objection because s/he is screwing around, all s/he does is have the last few sentences read back by the steno-girl and then rule on that.

If it's boring, the judge can go out and find a more exciting job - like skyscraper construction. Don't see them doing that much. A job is a job. Either do it well or call in sick.
There are tough jobs out there - even if it looks like you sit on your ass all day. Some are worse than others. And we are all people. We got our own crap to worry about. That sucks though. Because a lot of the time your actions can affect someone else. If you are a teacher and did not get any last night from your significant other - you might be not too lenient with grading the student's work. If you are a doctor, you might say "Here, just fill this prescription." and storm out the door. If you can't do 100% then don't try at all. Cause I got my crap to worry about as well and I just might take it out on one of these half-assed employees. He could have done the right thing immediately and entered a protest into the court record, but he chose not to until he needed another ace up his sleeve. Gutless coward.

- chesterpoop, on 10/12/2007, -1/+0I'm pretty sure there's a difference between playing cards during a court appearance for a speeding ticket and a murder trial. Especially one with any level of media attention. However, my major concern is with the following passage:
"Sliwa said he noticed the card-playing while on the witness stand at the first of two Gotti racketeering trials that ended in hung juries - but he didn't speak up until Scheindlin dumped cold water on the government's third try at convicting Gotti of charges that include ordering the attack."
There seems to be an issue in motive here. All of a sudden, this one person who saw it three times is speaking up after getting smitten, yet no one else saw or came out about this? This is a high profile case being pursued by the Federal Government and apparently this card playing was happening frequently enough over the past few years for one person to catch it on three or more occasions, but no one else during that time frame has said anything? - inactive, on 10/12/2007, -2/+1Hey, give that judge a break. - orenthal, on 10/12/2007, -1/+0assuming it is a jury trial the judge is only there to sort out matters of law. the jury is the fact finder. judges are almost never listening to what a witness is saying, which is why when there is an objection the judge will often have the lawyer or the witness repeat the testimony that is objectionable.
i don't see this as a big deal. the judge is there as a referee. as far as sentencing goes, the federal sentencing guidelines pretty much dictate exactly what the defendant will get. on top of that there will be a separate sentencing hearing after the trial in which all the factors that influence the sentence will be re-examined. - lupinglade, on 10/12/2007, -12/+11So what? At first... I thought the Judge was wrong..... but ya know what? Some people can just ramble on & on & on.....and it just doesn't require 100% of attention to listen. I can totally see this happening. I can't claim to know what's going on in the court-room... but I'm sure playing solitaire will not have a significant impact in the overall outcome of the trial.
