Uh, no it's not... Lol. If I go driving down Market street in San Francisco and my friend in the front seat takes some photos with my digital camera and I upload them to a photo album under the title "My Trip to San Francisco," is that evil? For that matter, is it evil to take photos of scenic locations if there are random bystanders in the field of view? It's the same concept. This is a completely public place, and these individuals are doing something that anyone else could have photographed and uploaded to the internet.
The only possible way that this could be considered sketchy would be if the photos peered into private property, but that's not even the 4th amendment, it's just peeping toms, which would probably just turn into a large-scale lawsuit, not a federal case of big brother. As long as the photos remain out on the streets, it's perfectly all right.
And before you idiots ask "what if they took a picture of you doing that?" I'll give you my response:
In the highly unlikely event that I'd just start fighting with someone in broad daylight as people and cars are passing by, I would just look at it and think "*****, why did I just start beating that guy up? Do I have a problem with rage? I chased that guy down-- Google caught me chasing that guy down! I feel like such an ass... if you stand in your window naked you cant get mad at a guy walking by for turning his head. You know when you walked to the window naked that there was a chance that someone could look at your window and see you. Now if your showering and a guy walks up to you window to get a look down your hallway, then you have an actionable case.
