The Chicago Yacht Club has found itself in hot water. For trying to save a woman's life.
The club has been slapped with a lawsuit stemming from an incident last March wherein an employee performed the Heimlich maneuver (unsuccessfully) on Claire Burnett Rice, after she choked on a piece of meat. The manuever did not dislodge the food and 911 was called.
Rice died about a week later due to complications resulting from anoxic encephalopathy, a lack of oxygen to the brain.
Rice's husband, Nick, is alleging that her death lies in the hands of the club because, according to the lawsuit, they, "assumed the duty to perform the Heimlich maneuver with due care." If you've never been in a situation where your self preservation instinct has kicked in after somebody else has been seriously hurt, you really have -no- idea what it's like.

HIV/AIDS be damned (the possibilities of getting it aren't that great). But even if i was afraid to help her physically I would have called the police. Even if they got 30 calls on one incident at least I know I called instead of letting someone bleed to death because I assumed someone had called. I mean come on that 2 minutes may have saved her life. What's even more sick is taking a picture? What the hell is that all about? How can you walk by someone injured like that and dying and take a picture? Pretty ***** up.

LOS ANGELES (AP) — A woman accused of rendering a friend a paraplegic by pulling her out of a wrecked car "like a rag doll" may not be protected by California's good Samaritan law, an appellate court ruled.
The 2nd District Court of Appeal wrote in a decision Wednesday that the Good Samaritan law only protects people from liability if they are administering emergency medical care. The perceived danger of remaining in the wrecked car was not "medical," the court ruled.
Attorney Robert Hutchinson who represents plaintiff Alexandra Van Horn, said the state's Samaritan law doesn't require people to render aid. But if they do, he said, they must act reasonably.
Van Horn was in the front passenger seat of a car that slammed into a light pole at 45 mph on Nov. 1, 2004, according to the negligence lawsuit filed against Lisa Torti.
Torti was a passenger in a car that was following behind the vehicle and stopped after the crash. Torti testified she placed one arm under Van Horn's legs and the other behind her neck to lift her out of the car.
Van Horn, who testified Torti grabbed her by the arm and pulled her from the car "like a rag doll," suffered injury to a vertebrae and a lacerated liver. Court documents said that the question of whether she was paralyzed during the crash or when she was pulled out of the car has been disputed.
Torti lawyer Jody Steinberg said he will appeal, saying the Samaritan law should protect everybody.
"There was no evidence that our client was doing anything but trying to rescue a person in need," Steinberg said. If she collapsed on entering the shop, you'd expect people to help rather than take pictures with their cell phones. Also going by jtmOBX's post, it makes sense to ignore people who are lying face down on the floor if you've just entered a shop, or you would be a ***** idiot.

This is all done in the name of Christianity. It's a cheap shot at Kansas but the guy has a point. In a state so concerned with morality and god fearing, it fails at basic human compassion. It's ironic and that is the point.

Often helping someone will get you tangled in their problems and could have you being held for questioning, have you charged, or something else you don't want. Today in the US there is no reason to help anyone because only bad things will happen to you. Seriously, no good deed goes unpunished here. So when the safest and best thing to do is to ignore it, why help someone?
