- domlachowicz, on 10/28/2007, -2/+19Let me start by saying that I don't think that Wilson did anything wrong, and it's shocks the conscience that he's served prison time for consensual intercourse.
The other 3 judges didn't necessarily think that what Wilson did was morally abhorrent or deserved punishment. They took the position that the legislature remedied the law in 2006, but didn't explicitly make the change retroactive. Since the changes to the law weren't retroactive, the judges didn't have grounds to commute his sentence to a misdemeanor. In other words, they weren't about to be "activist" judges and legislate from the bench.
The 3 dissenting judges took the opinion that in order to free Wilson, you should petition the legislature to make the law apply retroactively. Either way, the end result is correct. It's just that the means to the end were wrong.
But I'm really glad that he's out of prison. He had a promising life ahead of him, and I hope that somehow he can get things back on track. - codechino, on 10/28/2007, -1/+18That's the wrong kind of thinking.
