It might for the rational person, but chances are he was in such a rage that even if the death penalty was in place, it would have occurred to him at that time.

- mourne, on 03/25/2008, -2/+20I completely agree that he should never go free. Our justice system needs reworking when it comes to penalties. A person caught pissing in public can be charged with severe jail time and be forced to be on the Megan's law list, but my fiance's rapist convicted father gets 8 months in the non "pound me in the ass prison".
I just don't think the death penalty is the answer. Locking someone up forever, sure. Throw away the damn key. I don't believe someone like this will EVER be a productive member of society.
My main reason for being against the death penalty are all the false positives. How often is it to see lately that convicted poeple, even on deathrow, are being set free because of DNA evidence that wasn't available during the original trials.
Even if there is 1 false positive, it's too much. Murder is murder, even if we're on the 'righteous' side. Maybe someone else did beat his child and he is innocent? My point is that we can't be 100% sure. Even if we're 99.9% sure, that .1% is still someone's life we're gambling with.
