It pretty clearly states twice that the audio recorder was stashed in the daughter's teddy bear in an attempt to get evidence against the husband during their custody battle. If the parents handle it properly with the kids, it will probably have an overall better outcome for them. Sure they have to deal with the divorce, but it is always much better than being subjected to their meaningless squabbles and fights over everything. I can vouch.

A violation of the law = ILLEGAL
That is why she is being sued. That and the article does not state that the girl knew it was being recorded. In fact "Lewton, his daughter - who is now five - and five other plaintiffs who were recorded by the bear are requesting a jury trial. They seek $20,000 each, plus other damages and court costs, from each defendant for invasion of privacy and violation of state and federal wiretapping laws." If he says it was violation of the law, then it was probably a violation of the law, and not what you are claiming. The appeal system is great, but it is mostly used by lawyers to try to get a client out of trouble through some loophole. And actually, wiretapping is stated as "Interception and disclosure of wire, oral, or electronic communications."
