People will sue for ANYTHING these days, and if the girl slipped or anything, mommy sues and the insurance company tells RMCF "Sorry, we arent paying this multimillion dollar lawsuit. You arent covered for customers in the back room." Not to mention that if they let a non employee use the restroom and the person DOES NOT get hurt, they can be still be sued by that person for hot having an ADA compliant restroom, the person is entering a food preperation area and isnt wearing whatever protective clothing (hairnets, etc) required, and they are liable to the health inspectors. They did what they had too to survive in a lawsuit happy society.

In California we have been sued by a handicap person because he requested to use the bathroom and being nice we said yes of course. We got sued because the mirror in the bathroom was 6 inches too high which was somehow detrimental to his health. If this was a chain that didn't sell food I'd say they have the right to refuse but if you sell food or drink you have to allow use of your bathroom.

Unfortunately, as I'm sure you're by now aware, at a store of yours in Huntington Beach your employees acted in a manner beyond comprehension by not allowing a child to use your restroom in an emergency, resulting in the child ***** on herself. Way to go.
If that is how your company treats customers, I think I'll go spend my fudgemoney at your competitor.
Please issue a public apology and give this girl free fudge for life. That is the ONLY way I will ever eat your fudge again.

Management learned very quickly that you can't have a business directly across the street from an old folks home without one. Not exactly one of the highlights of my youth having to be in that situation *shudder*

We used to, but someone tried to sue us because we wouldn't let a bum he would sit outside use it every ten minutes. So we created a no-one at anytime policy (except for employees obviously). I empathize with the girl, really, but rotten apples ruin it for the whole bunch.

Running a business is a risk, people can slip anywhere in your businesses, the bathroom doesn't host a significantly higher risk to warrant special precautions.
Just ask yourself. Have you personally ever denied someone to use your bathroom out of fear of being sued?
Of course not, it's ridiculous for one, and secondly they are ALREADY in your house. If conspiring to sue you is their goal, they certainly don't need a bathroom as an excuse.
If anything they will want to trip and fall someplace public where many people can see them.
McDonalds didn't stop selling coffee because of lawsuts, they didn't stop cleaning floors. These are all the risks of doing businesses someone can slip and fall on the stairs, get food poisoning, start a fire, stub their toe. Bathroom use has nothing to do with it.
Plus, the going motif is that if you sell food you need bathroom AND beyond that the 10 to 1 rule, which states that for every one person you piss off running your businesses they go and complain to 10 others. Unfortunately only negative gossip travels that efficiently or we could all stop paying advertising costs also.
Folks... if ***** places like Burger King has a bathroom, you're not going to get away denying a 5 year old girl the bathroom in your chocolate store.
The smell and visual sight of her pooping herself in front of customers surely lost them more money than the theoretical lawsuit has. Each one of those customers has gone and told the story of the little girl defecating to 10 others and now they are moving up the digg ranks.
Doing business is risky, most store managers are just idiots who have no real clue how to run anything and that's why their profession is running a store. It's not an mba level management task or anything.
Many times the owner/manger thinks that because they've managed to open a store and attract a handful of customers they are somehow businesses geniuses. When in reality the measure is through long term success. Here we have a lot of these small stores that don't actually make money but the rich people behind them need something for the wives to do.
You get a lot of these stuck up idiots who don't know the first thing about keeping customers or the basic laws in the area that pertain to them.
Just as many people running convenience stores don't realize that they cannot refuse 100 dollar bills no matter how many signs they post saying it's store policy.
Certainly, the woman embarrassed by the store has a great angel for a lawsuit considering the mental trauma she and her daughter went through when publicly humiliated by this store
If I was 5, I'd remember that the rest of my life. *****... I remember the time we were short change for a Slurpeee and I cried my face off so the 7 11 employee gave us a discounted one.

Customers are messy and dirty, especially little kids. They are also prone to accidents. One video store I worked at used to let the customers use the bathroom for emergencies, but the following things led management to restrict access:
1) Customers crapping EVERYWHERE in the bathroom, aka lack of aiming ability...with their butts.
2) Guys jacking off in the bathroom...no, there was no pornographic material there.
3) A woman brought in her screaming brat claiming diarrhea (sound familiar?), and on the way out instead of thanking us she yelled at us for a non-pornographic poster of a woman in a bathing suit-- it was a regular movie poster --that was on one of the side walls outside the bathroom.
