I think they're right when they say that "Califonication" is immediately associated with the band in the mind of the consumer. Without a trademark though, I don't think that's enough for them to win the lawsuit.

No, Anthony. Your signature song is "Give it Away". Your signature CD is "Blood Sugar Sex Magik". Your signature video? "Californication" is definitely the most distinct video you've put out, due to it being entirely computer animated, but it is arguably not your most memorable. (I'm not sure that they have a signature video, if that phrase is meant to imply that when you think of the band you think of that video [like Michael Jackson with "Thriller"].)
I'm a big Chili Peppers fan, but this is pretty lame. Tom Petty refused to sue them after they inadvertently ripped off one of his songs and turned it into the lead single for Stadium Arcadium because he didn't believe their intent was malicious. Meanwhile, there seems to be a legitimate, non-RHCP reason for the title of the show, and the naming of the character Dani California sounds to me like a writer for that show is a Chili Peppers fan who made the TV show-album title connection and thought the character name would be a silly reference for other RHCP fans who watch the show. - CapeKid, on 11/20/2007, -1/+13*I meant trademark. It's trademarked as a song and album title, not TV show title. While you can't come out with a TV show called Jeopardy, you can make an album called Jeopardy. Sorry RHCP. But to claim that it's coincedence that there's a character named Dani California is nuts. Not like the Peppers are some unknown band.

David Duchovny calls her it once as a joke in reference to the song. Amusingly enough, all the titles of Hank (the main character's) books are Slayer albums. Are they gonna sue too? Its one of the best shows I've seen in the last few years, check it out before you condemn it.
