I think their testimony will probably be more related to the hegemony of the music industry and the ways they have been screwing over artists in recent times, probably testifying to the legitimacy of the RIAA as the voice of the artists. And even if everyone had downloaded it for free, compared to the usual record deal by the RIAA company (Sony, EMI, Universal, or Warner Bros), that is more than they would get. I hope they don't get trumped on that argument. But in all honesty, bands don't make much money at all on CDs anyway. Most just want you to have their music and come to their shows. The major component of a record deal is more of the marketing aspects they offer but those marketing strategies are now out of date. Bands like Radiohead and NIN have used technology to THEIR advantage and avoided the middle man.
