Happy Birthday to you,
Happy Birthday dear Time Warner
Happy Birthday screw you! - ralphmalph, on 10/12/2007, -0/+4great story. equally hilarious comment posted to the story by "carrie":
The happy birthday song has been covered by so many different artists, but my personal favorite version is by the Owens Family, live October 3rd 1997 at Applebee's: Martha's Birthday.
If you haven't heard it yet you should try to find a bootleg, its freakin sweet! - ToeKneeDee, on 10/12/2007, -0/+3Royalties are due, of course, for commercial uses of the song, such as playing or singing it for profit, using it in movies, television programs, and stage shows, or incorporating it into musical products such as watches and greeting cards; as well, royalties are due for public performance, defined by copyright law as performances which occur "at a place open to the public, or at any place where a substantial number of persons outside of a normal circle of a family and its social acquaintances is gathered."
So, crooning "Happy Birthday to You" to family members and friends at home is fine, but performing a copyrighted work in a public setting such as a restaurant or a sports arena technically requires a license from ASCAP or the Harry Fox Agency (although such infringements are rarely prosecuted).
Source- http://www.snopes.com/music/songs/birthday.asp - bcoughlin, on 10/12/2007, -0/+2They had an episode of "Sports Night" about this.
Hilarious. - erco, on 10/12/2007, -0/+1Correction request for title of article: "Man writes ASCAP a letter.."; the link is to Carrie McLaren's site and letter.
For sure Carrie is a gal; "Main|About" page on that site, a link to Carrie's interview:

..quoting the article: "McLaren also happens to be the woman.." - compu73rg33k, on 10/12/2007, -0/+1*****! I've sang Happy Birthday so many times without permssion. I hope I don't get sued. What if Time Warner goes all RIAA on us about Happy Birthday. They could effectively take out ... the entire English Speaking population. *****!
- digigal, on 10/12/2007, -0/+1And here I thought "Happy Birthday" was public domain.
You learn something new everyday at digg.com - funkkyhippo, on 10/12/2007, -0/+0l o f'n l
- Twenty, on 10/12/2007, -0/+0Damn, I miss Sports Night. That was a good show.
- jonra, on 10/12/2007, -0/+0"Why is this so hard to understand?"
Copyright issues are a technology issue in today's world.
Why is that so hard to understand? - skell, on 10/12/2007, -1/+1great story!
...now back to my torrent seeding of the happy birthday song in mp3 format, screw you DCMA! >;] - Reference, on 10/12/2007, -0/+0Referencing 'Sports Night' is an instant win. That means you won. Instantly.
- Seaton, on 10/12/2007, -1/+1That's Classic. +Digg
This kind of joke could backfire. By giving any agency your name and address and admitting use of copyrighted material, you open yourself up to any type of charges they see fit to levy upon you for use of the material. - deathBOB, on 10/12/2007, -0/+0ahh ASCAP... What a wonderful name...
- theminutetech, on 10/12/2007, -0/+0Hilarious!
- hagingtree, on 10/12/2007, -0/+0masterzora is sad IRL!
Social bookmarking site ftw? - jvelderman, on 10/12/2007, -0/+0I've eaten at Frenchy's before - good stuff.
The letter is hillarious. - jwalk81980, on 10/12/2007, -0/+0"its not ascap who is the bad guy... its the greedy grandchildren of the two women who wrote the song" ~ Posted by Eric
It took two people to right that song? - kimuuu, on 10/12/2007, -0/+0What about kareoke?
- cbotwell, on 10/12/2007, -0/+0Man some people care to much and actually have to go quoting the site is this is the kin dof thing users want to hear about leave it alone and i think someone should seriously send them an email asking for permission for thier band to cover it and do a live recording to see how they feel about that.
- cquinnd, on 10/12/2007, -0/+0Thats why you should sing "Spirit Journey Formation
Anniversary" instead. - NSXROX, on 10/12/2007, -0/+0Frenchy's is a great place to watch the sunset in Clearwater. Just watch for dirty pitchers of beer.
- siouxmoux, on 10/12/2007, -0/+0I would like to sing 'Unhappy Birthday' by the smiths to EVIL ASCAPs, RIAAs, MPAAs of the world!!!
- MaybeLater, on 10/12/2007, -0/+01000th digg!
- aside, on 10/12/2007, -0/+0Frenchy's doesn't have much food for vegetarians, though... and they undercooked half of our food. But alas, nice place when it's not red tide
- meangene, on 10/12/2007, -0/+0No, just two people to write it.
- hppyfngy, on 10/12/2007, -0/+0that's frickin awesome
- HiddenForce, on 10/12/2007, -1/+0She, along with her brothers, should form the musical group "Peter, Paul and Carrie."
- inactive, on 10/12/2007, -1/+0If they were to say no, I would refrain from singing the song during the time stated in the letter. Someone will be there waiting for them to defy the order and serve the subpenoa.
- VictorH, on 10/12/2007, -1/+0The trouble with "Happy Birthday" is that it is so short: copyright law allows you to quote a certain proportion (10%?) of a work (which would leave you with not much more than "to you"!).
This allows musicians to use "short "loops" of other people's music to build their own songs. You can write songs like this at home now - for free - with new recording software:
see http://www.software4free.org/recording.html for some titles. - masterzora, on 10/12/2007, -2/+0@hagningtree:
*sigh* anybody with a half-decent sense of grammar should be able to catch this:
"Digg is a technology news website that combines social bookmarking, blogging, RSS, and non-hierarchical editorial control"
According to this sentence (taken straight from http://www.digg.com/faq), the content of Digg is technology news. The way the content is presented is a combination of social bookmarking, blogging, RSS, and non-hierarchical editorial control. Although the content is presented in a social bookmarking-esque manner, the content itself is supposed to be technology news.
Why is this so hard to understand? - masterzora, on 10/12/2007, -2/+0Besides being old "news", this isn't tech news by any metric.
Report++ - Womp, on 10/12/2007, -4/+1Interesting, but I dont find that very funny... Last time I checked Digg was a TECHNOLOGY website... No digg! ! ! !
- theone3, on 10/12/2007, -3/+0Fie, Womp.
This is a social news network. - vapidsquid, on 10/12/2007, -4/+0god digg is so slow this was on boingboing at 11am this morning.
(hey, if you can bitch about slashdot being slow...)
