- sirhomer, on 10/11/2007, -2/+84Actually the image of Tux itself (the original one) is distributed under an open source license. The only caveat is that you must credit him with the creation. I don't this apply to images made from scratch, since the license seems to be for copyright and not trademark. You can read about Tux's creation here:http://www.isc.tamu.edu/~lewing/linux/
- muchaaa, on 10/11/2007, -6/+87Who says that open-source don't equals money?
- LGod, on 10/11/2007, -2/+61Maybe the ticket is running on Linux?
- TheRealToma, on 10/11/2007, -1/+58Dugg for the short conversation on the flikr page XD
- Pensador, on 10/11/2007, -3/+56That is hilarious! Where is it from?
- s1mph0ny, on 10/11/2007, -3/+38If your idea of a realistic penguin drawing is the linux penguin... you don't get out enough.
- cekim, on 10/11/2007, -8/+35People who know how to speak correctly...
- insomniac8400, on 10/11/2007, -3/+29The linux penguin doesn't wear a hat or carry a fishing pole. Clearly the lotto penguin is an original creation like Ricky Rouse, or Monald Muck.
- AdamSnow, on 10/11/2007, -17/+43Can't a penguin look like a penguin without infringing on Linux?
- gtawh, on 10/11/2007, -1/+17It's from the South Australia Lottery:
http://www.salotteries.com.au/Games/InstantScratchiesType.aspx?p=73 - snurfle, on 10/11/2007, -0/+16...So a penguin walks into a bar and says, "Has my brother been in here today?"
And the bartender says, "I don't know... What's he look like?" - 1jaxstate1, on 10/11/2007, -5/+19Going by the "year of linux" theme, no one will will this lottery for another 15 - 20 years.
- Otto, on 10/11/2007, -4/+18"Permission to use and/or modify this image is granted provided you acknowledge me lewing@isc.tamu.edu and The GIMP if someone asks."
That's if someone asks. If nobody asks, then you're free to use all you like. - DextaRussell, on 10/11/2007, -1/+13It'd be a winner then
- SamuelDr2, on 10/11/2007, -0/+10Publicity?
They never mention anything about either Linux nor Tux... - noahhoward, on 10/11/2007, -2/+11Yes, but this one chose not to.
- tylerbgood, on 10/11/2007, -1/+10should be a red hat though...
- gandhii, on 10/11/2007, -1/+8tux image is free for people to use however they want as long as they give props to Larry Ewing and "The GIMP if someone asks" ...
as already commented above:
http://www.isc.tamu.edu/~lewing/linux/
why do people like to spout off so much without even reading what has already been written? - Sibre, on 10/11/2007, -0/+6I was thinking that perhaps this might be one article in which the current state of politics in this country wouldn't be brought up, but somehow, you proved me wrong...
- cmw72, on 10/11/2007, -0/+5"I don't this apply to images made from scratch" ... Yes, but what about scrach-offs ?
- o0adam0o, on 10/11/2007, -0/+5Nope, the other penguin has a straw hat, fishing pole and his feet arent webbed...clearly 2 different penguisn...clearly...
- jkoke, on 10/11/2007, -1/+5Welcome to my block list, asshat spammer.
- TexanRudeBoy, on 10/11/2007, -1/+5The lottery penguin's feet aren't webbed, and his nostrils are different. Probably enough difference to avoid a lawsuit.
- zetamilk, on 10/11/2007, -0/+4Curious of the creator of Tux got permission from a real penguin to use it as a logo.
- SpaceDreamer, on 10/11/2007, -2/+6it is called Tux, not "Linux penguin"
- Ramble, on 10/11/2007, -2/+6There's a fish resturant that uses the tux logo near to where I live. As far as I know it's a pretty common thing to nick.
- Daniel001, on 10/11/2007, -0/+4It's not a coincidence – they have changed it a bit, but their image is plainly based on the linux penguin. They wouldn't get away with it if it was a normal trademark.
- MISDIREK7ED, on 10/11/2007, -0/+3That beanbagged guy is one ***** up individual... and no, I did not click his link.. especially after seeing where it went.
- inactive, on 10/11/2007, -1/+4until you get caught by RIAA, MPAA , EA and Adobe....
- WaterDragon, on 10/11/2007, -2/+5Right....Where's an open-source lawyer ( who does everything for free) when you need one?
The lawsuit could be about damages to the marketability of a commercial product (which is distributed for free).
He could sue them for zero dollars -- and then distribute the winnings equally among everyone who worked on Linux.
And if they won't capitulate, he could send them that new virus that runs on Linux -- the one you have to compile yourself. - reed311, on 10/11/2007, -4/+7I guess it's better to have a decent operating system, then a decent logo.
/off to use Photoshop and play some games. - joebob, on 10/11/2007, -1/+4Under the terms of this lottery you may freely redistribute either this ticket itself or the money obtained should it prove to be a winner. No restriction shall be placed on the method or object you use to scratch off this ticket. M$ may try to sue you for a portion of the winnings but they are just full of hot air.
- sw1val, on 10/11/2007, -1/+4I like his hat
- championchap, on 10/11/2007, -0/+3Umm, surely people who know how to speak English properly WOULDN'T say that.. and instead say "Who says that Open Source doesn't equal money?"
- inactive, on 10/11/2007, -0/+3what a liar.
he meant to replace smile with boner. - championchap, on 10/11/2007, -0/+3And dont forget Microsoft too, what arte the chances he has a legal copy of Windows?
- julianrod, on 10/11/2007, -0/+3But the subconscious... the subconscious!
- grendel, on 10/11/2007, -0/+3Alternate lesser prizes are burned .ISO's of Ubuntu.
- peagle, on 10/11/2007, -1/+3Obviously the box art from the forthcoming Linux: Deep Water Bass Fishing edition.
- omelette, on 10/11/2007, -3/+5The Story Behind Tux the Penguin
http://www.wired.com/culture/lifestyle/news/2001/03/42209 - championchap, on 10/11/2007, -0/+2You had 2 poles to choose from.. and you picked wrong.
Bad luck. - djGentoo, on 10/11/2007, -1/+3We call this GnuCash.
- gandhii, on 10/11/2007, -3/+5that would be the price of the apple lottery ticket
- pijalu, on 10/11/2007, -0/+2Some info: http://lists.linux.org.au/archives/linux-aus/2007-June/015758.html
- kirkness, on 10/11/2007, -1/+3Linux should sue for $25,001
- jeffyjones, on 10/11/2007, -2/+4First of all, there's a difference between a trademark and copyright. Know the difference.
Furthermore, who does anyone "own" said trademark when no one owns Linux? - j3one, on 10/11/2007, -2/+4Yeah, because cartoony looking penguins vary so much...
- iZealot, on 10/11/2007, -0/+2Oh there you are Mr.squeakers!
- ScottMaximus1, on 10/11/2007, -0/+2Is the bartender a Walrus?
- NinjaBoy, on 10/11/2007, -0/+1Its an md5 hash.
