- maz2331, on 10/10/2007, -0/+13Declaring bankruptcy one day before the start of a trial in a case SCO started is a real desperation move. Once Novell's case is decided and the amount is determined, Novell can move to change the Chapter 11 into a Chapter 7 liquidation proceeding instead.
BTW: The judge in original Utah case already decided officially that SCO is guilty of conversion (ie: flat out theft) and owns NO Unix copyrights at all. 95% of the license fees they collected are Novell's property, not a debt, and can't be discharged in Bankruptcy Court. SCO knows they are toast, but trying desparately to find any way to avoid being wiped out here.

I'm guessing they were hoping for a jury trial instead of this shortcut to a smoking crater where SCO used to be, but still, they did drag it out for 4(?) years with no evidence of copying (and even no copyrights it turns out!) Not too shabby a return for the boys in Redmond. I mean Lindon.

Novell is quite within their rights to firstly clear their name (as SCO accused them first), then get back the money that was stolen from them. They also have the right to stop the stealing, which they have made the appropriate moves to do.
SCO is nothing but a conniving den of thieves with no honor or humility. They deserve to be ground into the dirt with all dispatch.
