The gates were down!! That means he was able to pay enough attention to know the train went by then dumbass should know to wait until the gates go up. This is a case of no frickin common sense.

Guy was walking down the tracks next to my house, listening to an ipod, and couldn't hear a train coming.

As a person with ADD, I've experienced that when I'm concentrated on something, I can hear loud sounds and yet they don't ring a bell (like "hello, I'm here!"). However, that's no excuse for him to text message in the middle of a railroad.

A car would be understandable since something could have happened to the driver or car. A train, I mean come on, it's not like they come out of no where. I feel bad for the guy getting hit, but not for what he was doing that caused the accident.
