For the DS especially, pirated copies of games produced in China that work sometimes, partially, or not at all are quite common. While this service could be useful for those buying higher-end or rare merchandise it fails to address the more typical problem which generally keeps me away from ebay for games.

- Nanite, on 04/10/2008, -0/+4Heh, I saw this auction a few days ago. I agree with a few of the folks above me, it's a great excuse for raising the prices on near-mint stuff. I collect NES games and boxes, and I'd rather spend 10 bucks on a worn box than 250 on a "near-mint" shrink wrapped game. I'm not that serious of a collector. I also don't buy "sealed" games, there's nothing keeping a shady ebayer from shrink wrapping a game and calling it "sealed" and raising the price 150%.

My point is, and I even state it in my OP, that this really only caters to a very small and select group of individuals on the very high end (collectibles, rarities, promotionals, etc). A much more fundamental and common problem with ebay is pirated current games. And the pirated games really go across all the major systems; I just used the DS as an example since it's especially endemic in this case. So ten points to ebay for effort and minus several million for failing to cater to the needs of the majority of their video game consumers.
I'm not really sure where you pull the idea that I think this is mandatory or that people are still making pirate copies of Super Nintendo games. Anyways, also being a seller, the only games I have ever got to go above $5 was usually the rare, and well sought after games.
