Whether or not Sony had the right to sue, the fact they did, won, and forced a company near and dear to a lot of gamers out of business can't be viewed by anyone as a success, and can't help their bottom line very much. Do you understand how lawsuits work? Sony dropped the hammer on them with multiple lawsuits filed, and Lik-Sang can do the math; they can't afford to go up against Sony's money and legal firepower (and possibly their legal position, not saying they were in the right or wrong)
FWIW, Lik-Sang says they are returning any credits and unfilled orders, so they obviously do have money. Sony is protecting their distributors who they have contracted with to distribute their product. They are pretty much contractually obligated to fight any company that violates their agreements. If they don't sue, then they get sued by those company holding exclusivity rights of distribution. This stuff happens all the time. Sony may be a bunch of nitwits but I am not sure they had any choice in this matter. Sue or be sued.

Globalisation is a bad thing for Sony because it means people can purchase products from other countries where they charge less. Luckily for them they are able to rely on ancient trademark laws and of course brand their international products unsafe.

You would have thought if going out of business was really on the line they would have showed up?
It's almost as if they knew they were doing something illegal all along and instead of fighting it, they chose to close their site and make a splash in the press.

Actually, something very similar did happen to me. I bought a DS Lite from Lik Sang a couple months before they were out in the US.
My DS ended up having some problems, and when I called Nintendo, they said only Nintendo Japan could do warranty work on my unit, due to the serial number.
I knew exactly whose fault it was - my own for going outside the system. The US launch was only a couple weeks away, so I chilled out and waited for the Lite to come out here.
No one buys from Lik Sang expecting normal service from the companies that make what we bought, you're buying from a grey market importer, and that's the price you pay for getting something before everyone else. - rdtx2005, on 10/12/2007, -6/+11so it's a bad choice to sue a company that is breaching a contract by selling to other territories??

I don't understand why you two think there is no money, or that Lik-Sang has somehow spent all their money, and none of it on fighting Sony's legal actions. You both have asked "where is the money". I ask again, what money are you talking about?
There is nothing in this story from either side that says Lik-Sang is broke, or has spent all their money. The real reason Sony increased their legal power now is because they don't want Lik-Sang to ship the Region Free PS3s to Europe or other places that wont have them yet, they want to claim the largest launch in Europe when it is launched and if a few thousand people still have them early it will affect their numbers ever so slightly. - KingPsyz, on 10/12/2007, -1/+5Yes terrible move to stop them from ILLEGALLY selling THEIR product to other countries. Lest you forget, one of the reasons for regional releases is the region codes on DVDs and BLU-RAYs. The studios enforce these and if Sony were to allow them to continue to ILLEGALLY import systems and games out of their respective region they could be held liable for not protecting their copyright as well as their regional restrictions.
And how would SONY not want Lik Sang to sell PS3s to the EU so that they could do it themself? Either way Sony makes the sale nitwits.
I'm supprised infact that they weren't sued to oblivion before as I'm sure a fair ammount of their product is pirated. I read their little closing statement and it's was quite frankly long winded and unprofessional. Because mentioning that Sony employees bought systems and games from them is relevent... not like they don't have a direct pipeline to this merchandise. Like Sony retorted, it was part of their investigation.

The company still exists as of today, whether or not they're taking orders. That means the company still has to answer to whatever judgment might be handed down. Even if the company was completely defunct, the former executives and decision-makers would be held accountable. (For example, if the leadership shuttered the company and split whatever cash remained, those individuals might be expected to pay toward any fines or civil judgments; you can't just clean out the bank accounts and split town.)

This allowed the units to bypass the testing regulations for Europe. You understand? Its not like Nintendo or Microsoft(especially Microsoft) has tried to stop this before.
