Just because Digg fan boys are afraid of upsetting the "Great Kevin" they act all "we'll get in trouble." All I have to say is F a whole bunch of that, I say use the theme, distribute the theme and if the Digg boys are really so true to free open sourceness than they will keep their traps shut. If they send out a C&D then they are just hypocritical, sell-outs.

Technically you're not ripping all of the design in that sense, since the images aren't a copy, but the original work themselves.

dude just take out the rounded corners make it go all the way across, get rid off the digg logo. Also take away those inverted arrows showing where you are in the dashboard and release it.

I'm not a lawyer, but I still don't think that would be legal. You may not be hosting the images, but you're still using them on your site.
Direct linking to another site's images is also a jerk thing to do. It's only okay if you are doing it from either another site you own or one that you have permission from. Direct linking without permission is basically stealing bandwidth, why should some random site pay to host images for you?
And if the person running the site that you're borrowing images from notices (if they know what they're doing, they will), then you're just asking to have those images replaced with something hilarious and embarrassing. - greatclare, on 10/12/2007, -0/+3I agree I want this theme so so very very badly :)

I wonder if that is still true or if copying a design is something you can sue over, especially when they are not making money from it.

My guess is the demand for such work isn't that high. (not that it doesnt exist) If he'd done something truly unique or taken the design and somehow improved it in performance or usability, I could understand asking for his resume, but I didn't see anything like that.

As if... - kinthiri, on 10/12/2007, -1/+1@timdorr: No, if he links directly to the pics/images on the Digg servers and just releases the CSS then he is effectively stealing bandwidth, as well as stealing a design. So technically, he has to copy the images and include them with the theme if he releases it.
That of course brings up not only trademark issues (such as the digg logos) but also brings up copyright issues (Digg.com owns the copyrights to all the images on the digg.com site.)
I can't speak for US copyright and trademark law, but in New Zealand releasing that theme without permission from digg.com would get them in serious trouble.
On a more personal note, who wants to see Digg everytime they're working on their own blog? I'd rather have the admin dashboard look unique and more suited to my own personal style and personality than steal someone elses design. Digg.com has a good design....
