That would really tie up a lot of their resources now, wouldn't it? Then let's see how long it takes for Jesusland to ask for help because high-power corruption has grown completely out of control and they live in a fascist system... and now they envy the freedoms and super-developed technology, education, science and entertainment industries of Blue America. It's an important distinction. If a policemen enters a private residence where 10 people are sitting around getting high, if one individual says the weed is his, the others cannot be prosecuted for possession. Remember that the burden of proof is on the state. That's why laws are written so that a prosecutor has an opportunity to prove a case beyond a shadow of a doubt.
Possession is easy to prove: "You have it there in your hand. I'm arresting you for possession."
Dealing is also easy: "You accepted money for marijuana. I'm arresting you for dealing."
But to prove use, you would have to actually witness the action of using the substance. (Unlikely in most cases.) Most jurisdictions just never bother to write a law against something you can never prosecute.
You could be arrested for public intoxication, maintaining a common nuisance, contributing to the delinquency of a minor, etc., but not for toking. - gttim, on 02/05/2009, -1/+7Is Phelps suddenly an expert on pot?
