This is a very important distinction, and will fundamentally effect the finished design of the device. Closed it's an iPod (first), and open it's a cellphone (second).
So if Apple is unable to convince Cisco to let them use the term "iPhone" for the device, then they will use the next most obvious name for the device:
"iPod Phone"
/on a side note, if you imagine for a moment you are talking to someone who was less then fluent in the English language, and you tell them you are getting the new iPhone. The name "iPhone" was not coined by Apple, Apple has never even said they are making a phone. The whole things has been driven by the media and internet, where the name was coined only because Apple puts "i" in front of everything and its a phone. It isn't an official name, nor is it even an official project.
They can name it whatever the want. Even with the iTV, its just a code name, Apple said they would be changing that upon its release. Not everything Apple makes needs to have an "i" in front of it, nor does it have to be a literal name like "phone". If it was the iPod would be called the iMP3Player...not too catchy is it?

Are you on crack? Cisco's market capitalization is over TWICE that of Apple's (in laymen's terms: they are worth more than twice as much). Lots of companies have higher stock price, for example, than Microsoft, it doesn't make them bigger (though Apple might have more cash than Cisco).
Since Cisco is in an entirely different market than Apple, Apple has no bullying power (i.e. they have nothing to leverage over them).
And even if Apple was 10x as big as Cisco, what would they do? Buy Cisco JUST for the rights to the name iPhone (which they knew that they never had in the first place)? - Torv, on 10/12/2007, -1/+7iChat mobile?

It's very simple actually, Apple just needs to get the trademark back from Cisco. This doesn't take fancy legal arguing: "Your honor, Apple believes Cisco isn't properly defending the trademark Cisco has on the term "iPhone", and as such, we demand they lose said trademark. As evidence, we intend to offer all of the incidences of iPhone being linked to the phone product Apple incorporated may or may not be working on, and Cisco not going to any lengths to stop people from using this term in this way."
Once Cisco loses the trademark, Apple applies for it and hands out a few hundred bogus lawsuits to make it look like they're defending their trademark. - osiris24x, on 10/12/2007, -0/+2This is a fairly absurd article simply due to the fact that Apple hasn't given it ANY name in the first place, nor even confirmed its existence. So to ask "What is Apple going to name it *now*?" is a bit moot.
The other issue is that the "i" in iMac and iPod and iLife etc stands for "internet", which really wouldn't apply to a cell phone (though perhaps the iPod portion of the phone).
