I never even heard of the Caesars until that iTunes commercial a year or two ago. I also probably wouldn't have sat down and watched the Daily Show as often as I do if I didn't see funny clips online first.

However, FTA “People’s relationship with a brand is becoming a dialog, not a monolog.”, anyone else agree with me that it's the other way around? Companies used to think of the customer first, and that the customer is always right. Now it's all about the money and they don't care if they lose one of their millions of customers. Pair that up with bureaucracy and you've pretty much got a monolog. Examples of this are how companies can pretty much do whatever they want and get away with it, they no longer really care what the customer wants. - SoonerRoadie, on 10/29/2007, -0/+4It would definitely meet a prima facie case of infringement, but it would likely be fair use since he didn't use it for commercial purposes, its transformative, etc. See Bridgeport Music, Inc. v. Dimension Films 410 F.3d 792 (6th Cir. 2005)
In Bridgeport the court held that any copying of a sound recording, no matter how short in length, is infringement, it would then be up to the defendant to show that it was fair use. The case basically got rid of the de minimis doctrine for sound recordings. Which is kind of unusual because its a well accepted doctrine for any other medium of expression. The NYT needs some kids to proof read anything they write on technology because they obviously don't have there terms straight. In the article he tries to make a point that the comments ranged from liking the commercial to hating it and the reference he used was this:
"He uploaded his commercial to YouTube, where it received four stars out of a possible five and comments that ranged from “That’s awesome,” followed by 16 exclamation points, to “Makes me want to buy one and hack it.”"
