Student’s Ad to be used by Apple for the iPod Touch
nytimes.com — “I was sitting on the bus and I got this e-mail on my phone." The message said, “ ‘We represent Apple and we’ve seen what you have produced and we’d like a chat with you,’ ” Mr. Haley recalled, adding: “This seemed ridiculous and far-fetched. My initial reaction was, someone wanted to steal it.”

- brjndr, on 10/29/2007, -0/+63Just saw it for the first time, and for being put together by a college kid in 1 day, that is pretty damn impressive.
- Ireland, on 10/29/2007, -21/+7"The experience of working with the agency executives was “overwhelming, surreal and fantastic, all in one,” said Mr. Haley, who is studying politics at Leeds."
Politics? Ahahahaha!!!!!
"Mr. President, when your done with that iPod ad, there's a war we need to talk about."- theone3, on 10/27/2007, -1/+6Politics isn't about advertising. Got it. Never knew that. ;)
- limoo, on 10/27/2007, -2/+7It's okay. I think his biggest contribution is his choice of song. I won't be surprised if the final ad (is it available somewhere?) only bears a passing resemblance to his original -- large words keyed to the beats, and the "touched" Apple logo at the end.
- erictheninja, on 10/29/2007, -0/+1I just saw the add and it's pretty much the kid's video. Don't be a such a downer.

- mhender, on 10/27/2007, -3/+8No counting would be counting up to that many people who dugg it. Reading is reading the number. Good try crimson, you stupid douche.
- shawnz, on 10/27/2007, -8/+3thats what he meant, idiot. he can either read the number of diggs, or count the people in "who dugg or blogged it"

- utahnkid, on 10/27/2007, -2/+0And when did Digg become the place for only life changing news? Who cares about a guy that holds his dog up and gets peed on? I mean I'm pretty sure my life will go on whether I watch that or not but it's still funny/remotely interesting.

- ShrimpCrackers, on 10/27/2007, -0/+16Its amazing really, few if any other companies can get their customers to literally make ads for them, less rant all day about it.
- Salgat, on 10/27/2007, -3/+2I disagree. Then again, most commercials are either so-so or just way out there.

Well that is one more group of people going to try and make ads for Apple. You will get colleges putting hundreds up on the web trying to get noticed by Steve Jobs.
Awesome that this happened though.- Genma, on 10/27/2007, -0/+15customers advertising for free? brilliant!!!
- Homet, on 10/27/2007, -24/+16Is it just me, or was that just a horribly unoriginal commercial.
- synce, on 10/27/2007, -20/+12It was lame in general.
- Salgat, on 10/27/2007, -6/+5You might as well digg me down, because I agree with these guys.
- cyberoidx, on 10/27/2007, -2/+1Mr Salgat, I'm speaking from Apple. Whats your idea?
- ookxtreme, on 10/29/2007, -9/+51not polished; but, the kids got to be excited as heck!
CHEERS TO HIM! - def1234, on 10/27/2007, -21/+8congratulations on making it look like every other commercial. I'm impressed with how unoriginal it is.
- ManufactrsDfect, on 10/27/2007, -7/+4hahahaha it does look like every other apple commercial
- DarkSamus, on 10/31/2007, -2/+1wtf did you think it was gonna be like, a corona ad?
- def1234, on 10/31/2007, -1/+0duh
- crimsonnblue, on 10/27/2007, -17/+8wow just like every ***** other apple comerical. Ugh.
- bcrockett, on 10/29/2007, -2/+73We all know it's not a revolutionary idea for an advertisement, but that wasn't the point.
The thing he did well was to know music well enough to make the connection-and it turns out the two fit perfectly together. Not to mention that the ad fit the brand perfectly. - pulsifier, on 10/27/2007, -31/+5my penis is far too large for me to purchase any apple product. i mean, even if i wanted to, it would stop me.
- theinept, on 10/27/2007, -16/+11CSS are the big winners here. Forza 2 = Indie darlings. Apple commercial = KA-CHING.
- surfing, on 10/27/2007, -5/+6I like the ban Inline Styles better
- asaturn, on 10/30/2007, -5/+11wtf are you talking about? forza 2 the racing game? wtf? cascading style sheets?
- theinept, on 10/27/2007, -0/+7Someone didn't read the article...
"His spot offers a fast-paced tour of the abilities of the iPod Touch, set to a song titled “Music Is My Hot, Hot Sex” by a Brazilian band, CSS."- DarkSamus, on 10/27/2007, -1/+1cky ftw
- theinept, on 10/27/2007, -0/+7Someone didn't read the article...
- nestcrw, on 10/27/2007, -0/+3CSS = Cansei de Ser Sexy = the band that plays that song
- cvrefugee, on 10/30/2007, -0/+2I'm tired of being sexy?
- nestcrw, on 10/30/2007, -0/+1Yes! Actually, its a Beyonce quote.
- cvrefugee, on 10/30/2007, -0/+2I'm tired of being sexy?
- chroko, on 10/27/2007, -16/+3So basically he found the perfect music for an iPod Touch commercial (including the actual lyrics of "my music is where I'd like you to touch") - stole it and set a slideshow to it.
He's lucky that didn't end with a cease & desist order - and an FBI raid.- superkendall, on 10/27/2007, -1/+4Why do you think he didn't make a Zune commercial with Universal music?
They'd have their pound of flesh, and then some. - bjs3171, on 10/27/2007, -0/+3he could, like, you know, own the album...
it's not illegal to use any music you want in an amateur video.- tech42er, on 10/27/2007, -0/+2Actually, it is. Remember that case of the youtube video with the toddler dancing to Universal music. Universal sued them, and the EFF is defending them.
- iChainsaw, on 10/27/2007, -0/+1you can legally use under 30 seconds of a song in a amateur movie...
- superkendall, on 10/27/2007, -1/+4Why do you think he didn't make a Zune commercial with Universal music?
- pulsifier, on 10/30/2007, -24/+2you cant digg my penis comment down, it's the truth. my penis and apple, they're immiscible... like oil and water, it's just thermodynamically impossible. or like coldness is the absence of heat, big penis is the absence of apple products
- jasongdx, on 10/30/2007, -0/+2That's really ashame. Maybe you should look into getting yourself a vagina instead. I'd imagine it wouldn't get in the way much.
- pulsifier, on 10/30/2007, -2/+0too easy...
i know, a vagina is a requirement for being a mac owner. haha, you dumb dick.
- pulsifier, on 10/30/2007, -2/+0too easy...
- cyberoidx, on 10/27/2007, -0/+1Wow! Not tired of being dugg down in the same story already are you?

If Digg stories showed the number of buries, you'd ost them to get your story Dugg Down.
Move to reddit. They have such a feature for you.- pulsifier, on 10/30/2007, -1/+0lol. i care. get over it virgin.
- jasongdx, on 10/30/2007, -0/+2That's really ashame. Maybe you should look into getting yourself a vagina instead. I'd imagine it wouldn't get in the way much.
- djbelieve, on 10/27/2007, -2/+44What about posting a video to YouTube with copyrighted music? Isn't that a problem? Just wondering...
- Malarie, on 10/27/2007, -3/+2230 seconds is not stealing.
- jasonhe, on 10/27/2007, -2/+5It's only a short sample of the track so I think it's OK. (IANAL)
- betobeto, on 10/27/2007, -4/+4I've seen literally thousands of videos on YT featuring copyrighted music and used most likely without permission at all. One more to the big pile won't make a difference.
- Salgat, on 10/27/2007, -2/+1There has been thousands murdered in this country, one more won't make a difference. See how your logic is flawed? I don't mind copyright infringement of music, but I do mind terrible arguments like the one you presented.
- tendonut, on 10/27/2007, -0/+6I doubt the RIAA sees 30 seconds as not stealing. If only they saw how YouTube helps the movie/TV/music industry. I never even heard of the Caesars until that iTunes commercial a year or two ago. I also probably wouldn't have sat down and watched the Daily Show as often as I do if I didn't see funny clips online first.
- fortezza, on 10/26/2007, -0/+1Yes, they are taking down videos intermittently. There was a channel with people lipsyncing and acting out songs from Disney movies, the whole channel was shut down after a year or so on Youtube. They had a ton of subscribers, too .
- opiniastrous, on 10/27/2007, -0/+1As I understand it, using less than 30 seconds is actually OK. You don't have to pay royalties or anything like that. I remember seeing a bunch of McDonalds toys that played a certain song (but only 29 seconds worth!).
- SoonerRoadie, on 10/29/2007, -0/+4It would definitely meet a prima facie case of infringement, but it would likely be fair use since he didn't use it for commercial purposes, its transformative, etc. See Bridgeport Music, Inc. v. Dimension Films 410 F.3d 792 (6th Cir. 2005)
In Bridgeport the court held that any copying of a sound recording, no matter how short in length, is infringement, it would then be up to the defendant to show that it was fair use. The case basically got rid of the de minimis doctrine for sound recordings. Which is kind of unusual because its a well accepted doctrine for any other medium of expression. It's a widely criticized (and hated) decision. - DanaLynn86, on 10/27/2007, -0/+4I do realize CSS isn't going to be upset about how their song was used. However, I received a cease and desist order over a 45ish second clip of my friends and I signing Little Red Corvette at a karaoke bar while on vacation. Now please, explain to me how that is not fair use?
- ZPWeeks, on 10/27/2007, -0/+1My guess is that CSS will get a pretty penny from Apple for the legit use of their song, so they probably won't complain unless they have psycho lawyers with more trigger-happy cease-and-desists than even the MAFIAA.
- edru, on 10/27/2007, -0/+1Sampling is sampling regaurdless. Its illegal to use. But seeing as this guy made no money from it, i doubt he will get any flack.
He's probably getting paid now, but the band will too.
- bluesyme, on 10/27/2007, -10/+5That was really nothing special, but congrats to the kid
- mmaf, on 10/28/2007, -8/+33I wonder if Apple is gonna keep the music, since CSS signed to do promotional ***** for the Zune since last year?
The funny thing is I remember Apple fanboys talking smack about the band and MS because "they could only manage to sign small indie acts like this."
Im sure after CSS become the next "Feist" the fanboys will suddenly be buying their music in droves.- naonao, on 10/27/2007, -0/+6I like Feist years ago and I liked CSS way before this, I only like to see them getting more fans, how can that be a bad thing? And this is a great advert, I don't think you're focusing on the best part.
- zeptobyte, on 10/27/2007, -0/+1I don't think the commercial would be so great if it weren't for the song. It fits well.
- rawheadrex, on 10/28/2007, -1/+3"The funny thing is I remember Apple fanboys talking smack about the band and MS because "they could only manage to sign small indie acts like this.""
Whoever said that was idiotic. However, turning it around and portraying it as if that sentiment represents the sentiment of all Apple fans, is beyond idiotic.
Whose music did Apple choose for their very first iPod commercial? Propellerheads. Bands don't come much more indie than that. - neseus, on 10/28/2007, -0/+5Whats a "zune" ???
- naonao, on 10/27/2007, -0/+6I like Feist years ago and I liked CSS way before this, I only like to see them getting more fans, how can that be a bad thing? And this is a great advert, I don't think you're focusing on the best part.
- Mac101, on 10/27/2007, -7/+1Awesome, user created commercial, cant wait to see it.
- UnfrozenCaveman, on 10/26/2007, -5/+0sorry wrong story
- tyler71, on 10/27/2007, -3/+10They should have just made love and listened to death from above
- AShriveledSack, on 10/27/2007, -4/+1the smashing pumpkins song? i don't get it
- Odymind, on 10/27/2007, -0/+5It's a reference to a CSS song...
- c0ldfusi0n, on 10/27/2007, -7/+2Very nice. From Apple, the advertising company and the guy who made it. However, i hope people won't see it as a trend. The last thing we need is to have our intarweb filled with wannabe user-created ads in the hopes to get picked up by the big guy.
- chris9902, on 10/27/2007, -1/+17I'm guessing Apple liked the song choice and if they didn't contact the kid first the next story would've been "ZOMG APPLE STEALS STUDENTS WORK!!!"
Good for him.- cyberoidx, on 10/27/2007, -0/+2Thats why they contacted him.
"Lets just steal the idea"
"What if the kids a digg user?"
- cyberoidx, on 10/27/2007, -0/+2Thats why they contacted him.
- praetorianpi, on 10/27/2007, -2/+5Cheers to the guy, he made a brilliant ad. The nice thing is both parties will have some good returns on it - the guy might get offered a job somewhere for advertising, and Apple will sell more iPods.
- jthomp, on 10/26/2007, -3/+1very cool.
- oppokaze, on 10/28/2007, -12/+5Not the first time apple has taken an ad from someone else. At least this time they're being open about it rather than, say, stealing.
- vermax, on 10/27/2007, -10/+4what's so brilliant about this? pretty generic. technically unremarkable.
compared to those colorful energetic iPod ads it's a dim shadow. - Malarie, on 10/27/2007, -11/+4Apple is over rated. Its made in China like everything else.
- vagarach, on 10/26/2007, -0/+2Still, they manage to make some really good looking stuff at the same major specialist manufacturers in china that other companies use.
- limoo, on 10/26/2007, -0/+1Yeah, it's made in China like everything else. That means nothing. It's like saying gourmet food is overrated, it's made of the same dead organisms as my $1 burger from the drive through. Obviously there's something more.
What differentiates Apple products from "everything else"? "Designed by Apple in California". http://www.joelonsoftware.com/items/2007/10/05.htm ...
- acbeck58, on 10/27/2007, -1/+5Dugg for using a CSS song! Awesome.
- liquisoft, on 10/26/2007, -1/+1I'm very excited for this guy. It's a good little video, too.
- bjs3171, on 10/28/2007, -1/+23do you think NYT realizes they didn't put one image, or link to either the original video or the polished video? i have no idea what the ad looks like, so why would i give a ***** about their article?
- zeptobyte, on 10/27/2007, -0/+8There's a link to the original at the top on the left-hand side. It looks like it's a link to another news story, but it's to the video.
- jorgepblank, on 10/27/2007, -0/+4Pretty cool.
However, FTA “People’s relationship with a brand is becoming a dialog, not a monolog.”, anyone else agree with me that it's the other way around? Companies used to think of the customer first, and that the customer is always right. Now it's all about the money and they don't care if they lose one of their millions of customers. Pair that up with bureaucracy and you've pretty much got a monolog. Examples of this are how companies can pretty much do whatever they want and get away with it, they no longer really care what the customer wants. I don't know, I probably just understood that phrase wrong. - bjs3171, on 10/26/2007, -1/+1nice little editing job. cool.
- Sheff, on 10/27/2007, -2/+5Hopefully he gets some money for it. If he refuses, Apple would just duplicate the ad anyway.

- utahnkid, on 10/27/2007, -2/+5Hahaha did no one else catch that? The NYT needs some kids to proof read anything they write on technology because they obviously don't have there terms straight. In the article he tries to make a point that the comments ranged from liking the commercial to hating it and the reference he used was this:
"He uploaded his commercial to YouTube, where it received four stars out of a possible five and comments that ranged from “That’s awesome,” followed by 16 exclamation points, to “Makes me want to buy one and hack it.”"
Someone needs to teach Stuart what "hacking" is.. And that when it involves an iPod it doesn't involve an ax as much as a keyboard and mouse.- gavintlgold, on 10/27/2007, -0/+4That actually is kind of funny... though I believe you are getting dugg down by grammar nazis, and folks would probably say "You need to proofread your own comments" ...
- utahnkid, on 10/27/2007, -0/+0Umm.. Ok? I would have to tell those people to lay off on the grammar and focus a little bit more on comprehension. My point was they didn't know what hack meant. Not that they didn't know the difference between there and their. Is it more important that you know what you're talking about or that you can spell? (not counting when you're in a spelling bee ;)
- ewokdown, on 10/27/2007, -0/+1I don't see how your criticism's even legit. I'm pretty sure the author's point was "hey, this video got really good ratings, and comments ranging from Positive Feedback A to Positive Feedback B."
- utahnkid, on 10/27/2007, -0/+0Haha not quite. Why would you say Something "ranged" from good to good? Not too much of a "range" there. Gotta give you credit for trying though. Keep it up.
- gavintlgold, on 10/27/2007, -0/+4That actually is kind of funny... though I believe you are getting dugg down by grammar nazis, and folks would probably say "You need to proofread your own comments" ...
- InContrast, on 10/27/2007, -0/+5I hope he is getting paid. Apple probably just saved $15-20k right there.
- Yodacola, on 10/30/2007, -0/+2Actually, Apple really isn't saving much. It is an advertising agency that is coming out on the top. Apple still pays the same.
- chokeaduck, on 10/29/2007, -1/+7Not an applefanboi but I'll admit that is a pretty cool ad.
- Felix57, on 10/29/2007, -6/+2not knocking the touch but psp is underestimated as they can do all of those functions without the touch but can do descent gaming and now the ability to play back media on a television from the device
- DarkSamus, on 10/27/2007, -0/+1which is why i bought a psp instead of an ipod, however most people don't like the size of the psp as a music/video player especially if they're not gamers
- xxbrighteyed, on 10/28/2007, -1/+1as much as people are going to digg me down for this, that add was a pretty obvious connection, channel 10 in australia have very similair ads (with the touching of the logo)
i think apple are paying him so that they dont get sued for doing what they already planned to do - TinFoil209, on 10/27/2007, -0/+1I think Apple's "rough" video was better. This movie is too fast.. Many people will say "WTF was that?!? Did you fart???" Plus the music on the rough ad is sleek. Almost sounds like a 007 soundtrack.. http://www.youtube.com/watch?v=_SctNJUtBLY
- DigitalN, on 10/27/2007, -1/+2Wow, no wonder the entire country has ADD. look at how fast everything moves!
- shadowblade989, on 10/27/2007, -1/+2burried for not having the ad in the article
- zonk3r, on 10/27/2007, -1/+1but the bigger question is did they iChat with him? Hmmm....
- Wagnerian, on 10/27/2007, -1/+0The video is fine, craft-wise. But I can't be the only one who finds the topic of consumers making advertising UTTERLY BANAL?
