The only development they seem to be hoping to make is some software to recognize mouse gestures, but there is already software out there that recognize mouse gestures too.

Like it or not blake, but I think you are oversimplifying why Apple's being successful lately. Sure, touchscreen phones were around before the iPhone, but the iPhone didn't simply copy them. They rethought what a phone should be, and why it should be touchscreen. That and the speed of the animations, and the lightness or the UI was totally "new". The made the Smartphone accessible to consumers, easy to use, and cool too.
If they do to the tablet market what they did to the phone market, they won't be just copying others (as you put it) they'll make it different. And making it better looking is just a bonus. What they actually patented was a user configurable mode affecting page up/down which would allow a person to easily go to the exact same point on a page regardless of zoom level, and automatically adjust for things like different page sizes.

Well said, but I have to admit to being an Apple basher for many years...
I only changed my mind when I bought a MacBook Pro (for the price, the hardware specs were way above any other laptop back in late 2006 ).
In a few months time my MacBook will be 2 years old -- and I now do all my development under OS X.

I'll give you the Apple III, the crappy "wtf-were-they-thinking" puck mouse, and that QuickTime and Windows don't play well together.

Go and do a bit of research about the above products you listed as "Apple fiascos "
The Lisa was the first commercial OS with a mouse and a GUI front end (Apple licensed Xerox research and even hired Xerox engineers as contractors on this project).
The Lisa was expensive, the hardware was way underpowered for what the software was trying to do... but the "Lisa" was also the seed for the "Mac" and ( much later, MS "Windows").
The "Newton" was a market failure, but it led to the formation of a joint partnership between Apple and Acorn to form ARM. Your mobile phone has an ARM (or an ARM tech licensed to Samsung) processor in it.
The first Mac portable led to the entire laptop market being where it is now.
Look at your tech history and you will find Apple has ALWAYS led, and when you're on the bleeding edge you do (sometimes) bleed quite a lot.
I grew up in the days when "microcomputers" were being sold but no-one knew what to do with them (besides play games). The most popular software running on those things (besides games) were mostly "recipe / cooking" programs.
In fact, the first spread-sheet (Dan Bricklin's "VisiCalc") was coded and running on an Apple II :

The software issues that might pose a problem but could be worked out over time. Apple has been working on independent resolution since 06? The fact that it illustrates the zooming action in the patent tells you something.
The OS X dock has been doing this since the beginning. There are perhaps some issues that we don't know about but I think Apple has been working on this longer than we realize. A mac tablet may never happen and this doesn't prove all that much since nothing has come of it in 3 years since it was filed. At best there are some similarities between gestures and what is in use in the iPhone but I'm sure they have a seperate patent for that too along with countless other ones for things they will never utilize.
