- thanksgiving, on 10/12/2007, -14/+94WTF? Why? It's only positive publicity for Apple
I'd like to know why they are so territorial over casual usages of their product names, its just silly. - inactive, on 10/12/2007, -7/+84@Tritelife
Their trademark can be eliminated if iPod becomes part of our language. So says the law. - hungryduck, on 10/12/2007, -3/+64''You can do some googling on any search engine for more info'' Best Line Ever.
- TriteLife, on 10/12/2007, -40/+101Because more than likely not everyone brings in an IPod. I can't really imagine them turning away a Zune or any other mp3 player...
Referring to all MP3 players as IPods == bad.
It can cause uneducated people to believe their budget 64mb mp3 player is an IPod, or it can kill a trademark if the term becomes to common.
You can do some googling on any search engine for more info. ;) - Yez70, on 10/12/2007, -1/+43MP3 Monday sounds better anyway.
- gcnaddict, on 10/12/2007, -7/+35"its just silly."
It's funny because Microsoft (the usual magnet of bad press around here minus the 360) hardly ever tries to protect its intellectual property. Heck, even when old Longhorn (vista) builds leaked, they didn't sue people over it. They just let it spread (and fired the leaker). - tom6a, on 10/12/2007, -3/+24Apple has developed a reputation, for good or bad, of protecting their names by getting lawyers involved. Just a couple weeks ago Apple went after bloggers who used iPhone screenshots.
Apple Challenges Bloggers Over iPhone Screenshots
http://www.omninerd.com/2007/01/14/news/1100 - knute5, on 10/12/2007, -1/+20I think he should rename it "Mobile Music Monday" or 3M for short!
Wait... - inactive, on 10/12/2007, -14/+30...Apple and Youtube are the new Microsoft...
- inactive, on 10/12/2007, -5/+19Why not link the article http://www.desmoinesregister.com/apps/pbcs.dll/article?AID=2007702090400 instead of spamming your idiotic blog?
- uberdesigner, on 10/12/2007, -8/+21I like how Apple pretends to be a happy feel good company when if fact it's a greedy slimy corporation.
- MikeKnoop, on 10/12/2007, -0/+11"Their trademark can be eliminated if iPod becomes part of our language. So says the law."
I would argue that it already has.
I'm a senior in High School, and EVERYONE (teachers, administrators) uses the term iPod in place of MP3 player.
In detention, rule #4 "NO IPODS, CD PLAYERS, OR CELL PHONES" (yes it's written it caps)
Teachers automatically assume if you have headphones on, you're listening to an iPod.
"Mike, put the Ipod away".
and so on.
-Mike - Atomic1fire, on 10/12/2007, -3/+13or music monday
- Nysul, on 10/12/2007, -4/+13The bar owner should start Zune mondays. Sure, they would only get 2 people, but at least MS wouldn't send a pack of lawyers at them.
- sexycommando, on 10/12/2007, -1/+10I dunno, if the Zune picks up more owners it might become popular thanks to the wifi sharing
- idesign, on 10/12/2007, -1/+9It's the link that came up in my RSS reader, and it's not my blog.
- barc0001, on 10/12/2007, -1/+8Bull. As was said on Boingboing about this:
http://www.boingboing.net/2007/02/09/apple_sends_stupid_t.html
"Please, fanboys, don't send me dumb notes averring that Apple's failure to police this use of its mark will lead to the end of its ability to stop manufacturers from producing rival MP3 players and calling them iPods. That's a fairy tale that trademark lawyers tell their kids when they want to reassure them that they'll have a healthy college fund. Courts don't declare trademarks generic because they're used descriptively to describe an actual use of the actual product."
And for those who like on the source's forum brought up Xerox and Kleenex, take this challenge: I double dog dare you to start a facial tissue company that in any way, shape or form uses the word Kleenex, or a document imaging company that uses Xerox in any manner. Tell me after you get sued into oblivion exactly how "public domain" those marks are, ok?
This is more of Apple's lawyers being dicks for the sake of being dicks, because in part the Apple community has long given them a pass on this kind of behavior, so to them it's not outrageous, it's the norm. - phatalbert, on 10/12/2007, -2/+9but referring to all internet searching as googling == ????
- inactive, on 10/12/2007, -0/+7You are being Dugg down because you are incorrect.
- eurleif, on 10/12/2007, -0/+7Trademark.
- inactive, on 10/12/2007, -1/+8Yses..that is ttrue. But a bar saying iPod Mondays is NOT going to kill he trademark. Guess what? Band Aids is STILL A TRADEMARK! Go figure! So is Xerox, and Q-Tip. And they are FAR more generic than iPod EVER will be.
Again...if this story was about Sony shutting down a bar's Playstaiton Tuesdays or Microsofot shutting down Vista Thursdays, you would all be pounding away at your keyboard so hard with derogatory comments it would be hysterical. - SmartITGuy, on 10/12/2007, -5/+11It won't be long before Apple sues every media outlet on earth for using the word iPod in articles ABOUT the iPod.
***** the iPod, ***** Apple, ***** Steve Jobs, ***** all their lawyers, ***** all the (iPod/Apple/Jobs/Apple-lawyer) fanboys - and ***** anyone who diggs me down for not worshiping any of the aforementioned...
Maybe if we ALL just ignore them completely they will just go away and die a miserable and agonizing death.
Anyone who diggs me down drinks rancid elephant semen. - Lobstertacular, on 10/12/2007, -1/+7You're right, iPods are better when we use them to block out the world and avoid talking to people. Also, any sharing of music should be done online and illegally so that we don't have to deal with any of that icky personal contact. Horrors.
- SniperGX1, on 10/12/2007, -1/+7I agree, he shouldn't be using the name iPod, it would be better to call it "Apple, Inc. Can Suck My Dick Monday"
- inactive, on 10/12/2007, -0/+5Besides, a bar is a bar. I live in Kansas City now, bars here are no better or worse or even different than those in Des Moines. If theres beer and flailing attempts at sloppy sex, its a bar. No matter where you are. Period.
- jdaniel284, on 10/12/2007, -1/+6Hi, I'm a PC. Hi, I'm a Jerk.
- woogley, on 10/12/2007, -1/+6man, and apple gets pissed when cisco throws a fit with brand names..?
- Atomic1fire, on 10/12/2007, -3/+8they allready did
- SoxFanNH, on 10/12/2007, -1/+6Idiotic move by apple...
- redxii, on 10/12/2007, -1/+5I would be careful about searching for "iPod", since you are not allowed to use that key sequence without authorization.
- soogy, on 10/12/2007, -0/+4Use a tricky font in which "a" looks a lot like "o", or "*" aligned lower, or even a "lowercase 0", if you will. Then voila, iP0d Mondays, and no one will even notice the difference.
- Jarasmen, on 10/12/2007, -2/+6First rule of Apple: you don't talk about the iPod.
- Willeth, on 10/12/2007, -0/+4A Zune meet would make a lot more sense. At least then you actually CAN share your music collection, and it means you want to come back each week after the tracks deleted themselves. :)
- idesign, on 10/12/2007, -1/+5Again, not my blog. Just a site i like. Saw the story in my RSS reader, linked it to Digg.
This type of shiat is starting to become more and more annoying on this site. If you don't like, don't post, don't digg. Just ignore. - mancat, on 10/12/2007, -0/+4greyspec, you sir are a complete moron
- inactive, on 10/12/2007, -3/+7You have to actively pursue any and all trademark violations not doing so is cause to lose the patent later on in court. See Apple - Cisco iPhone negotiation.
- djcll6122, on 10/12/2007, -1/+5he should listen, because apple would neeever use another companies product name for their own personal benefit, cough cisco iphone cough, without obtaining permission first.
practice what you preach apple - inactive, on 10/12/2007, -0/+3The majority of the patronage at that bar (or at least last time I was there last year) is all about the underground, they had some good stuff last time I was in there (Thievery Corporation, Ween, Aphex Twin, etc). Granted there was a time or two when Green Day infiltrated the system, and jillions of moans followed soon thereafter.
- inactive, on 10/12/2007, -9/+12ksgant you are the most ridiculous and outlandish apple fanboy ive ever seen lmao, wow the things apple fanboys will say to defend that filthy corporation. i wonder if this thread will be as ridiculously riddled with excuses as the Apple DRM one was. we are off to a good start...
- uselessexpert, on 10/12/2007, -7/+10Apple talks a good game, and then...BOOM....just like the RIAA...
Isn't wonderful what happens when the tables are turned? - cedric, on 10/12/2007, -0/+3Once again this tells us one thing: The Corporations own our arses.
- Avalontor, on 10/12/2007, -0/+2What kind of fanboy would believe the iPod(can I say that) is the original. Get a grip, so everyone is too stupid to know the truth. right?
- subversive1, on 10/12/2007, -1/+3It's all *****.If I owned a company who's name became iconic with a certain product,I would be proud. That is more FREE advertisement for me.It's a crap shoot for that type of status to be achieved.I suppose next Kleenex is going to sue if someone asks for an off brand tissue while using their name?Make me a Xerox copy, etc. You get my point.I,therefore give a big fat ***** YOU to Apple's lawyers. It's this type of ***** that just makes life aggravating. /rant
- PhantomZmoove, on 10/12/2007, -5/+7Shhhh! You want 3M suing you next?
- krached, on 10/12/2007, -1/+3@SAND1
Patents are not trademarks. It is simple not spouting off about ***** which you know nothing 101 - BobTGoon, on 10/12/2007, -0/+2As a new, semi-regular patron of iPod Monday's I can honestly say this is complete, unmitigated ***** on Apple's part. Clint is a wonderful guy and has done a lot to promote not just iPod's, but the Apple brand itself. This is terrible news, and I will be there Monday night to send IPM off in style.
Damn Apple for shooting themselves in the foot and ruining one of the only decent things to do in this town on a weeknight. - Kyoushu, on 10/12/2007, -0/+2Wow, a little angry?
- MAChaha, on 10/12/2007, -1/+3$teve Job$
- smackifilia, on 10/12/2007, -3/+4You know what, as I write this from my fresh and dearly loved Macbook Pro, ***** you Apple. Theres no reason to keep people who love your products from having fun together with them. And how are people supposed to know about an iPod event without putting iPod in the title? Maybe its just me but a "Digital Music Player that happens to be made by Apple Inc. Monday" sounds pretty ***** lame. I would say call it "iMonday", but apple would probably put the kibosh on that as well. They need to just chill and realize that these people are Apple SUPPORTERS and were just trying to have fun with the product and not so much trying to score money off Apple's name.
P.S. smartitguy, you got a digg up from me strictly for "rancid elephant semen" - SmartITGuy, on 10/12/2007, -1/+2And the US government and all it's ***** lawmakers handed your asses to them on a silver platter. ....And YOU all paid them (through your hard earned tax dollars) to do it too!
