Oracle has sent a force-majeure notice to the developer of Project Jupiter, a massive AI data center campus under construction in southern New Mexico, Bloomberg reports, citing people familiar with the situation.

The notice went to a unit of Blue Owl Capital, according to the report. Oracle is seeking protection from payments if the campus does not open in 2028 as planned, CNBC reported. That is narrower than canceling the project or ending Oracle's role as its main tenant. CNBC said Oracle shares fell 4% on Sept. 24 after Bloomberg published the report.

A project already navigating permit fights

Project Jupiter is planned for Doña Ana County near Santa Teresa and is intended to host AI infrastructure for Oracle and OpenAI. Its power plan has changed during development. Oracle said in June that an updated application replaced an earlier gas-turbine and diesel-generator design with a Bloom Energy fuel-cell microgrid.

The new design did not end the project's regulatory uncertainty. In August, the Albuquerque Journal reported that the New Mexico Supreme Court temporarily paused proceedings on a key air-quality permit. The same report said the State Land Office had twice rejected requests to route a gas pipeline across state land.

Those obstacles help explain the financial significance of the reported notice. Force majeure is a contractual mechanism that can excuse or delay obligations when events outside a party's control disrupt performance. Whether Oracle's notice meets that legal standard, and how the developer will respond, remain unresolved in the public reporting.
