    TLDR

A reply from Jennifer Huddleston at Cato notes the case raises First Amendment issues extending beyond AI and links to her earlier writing on the Anthropic lawsuit. A post from Rohan Paul states a federal judge blocked Pentagon blacklisting of Anthropic as illegal and baseless. The post adds that the judge found no adequate basis in the record and tied the action to the company's public criticism. The Pentagon had moved to designate rather than simply end its Claude relationship.

@nytimesBreaking News: The Trump administration acted illegally when it labeled Anthropic a security risk and blacklisted it, a federal judge ruled. https://nyti.ms/3SZOMA3
@rohanpaul_aiFederal judge blocks Pentagon blacklisting of Anthropic, calling it ‘illegal and baseless’ Lin found no adequate basis for treating Anthropic that way and concluded the government's own record tied the punishment to Anthropic's public criticism. Rather than simply ending its Claude relationship, the Pentagon designated Anthropic a supply-chain risk, a category aimed at threats such as sabotage or system subversion. Judge Rita Lin had already issued a preliminary injunction in March, stopping enforcement while Anthropic's challenge moved through court. The new summary-judgment ruling goes further, finding First Amendment retaliation, inadequate 5th Amendment process, and violations of the governing statutory scheme. The dispute began after Anthropic refused to authorize Claude for mass domestic surveillance or fully autonomous lethal warfare, while the Pentagon sought broader lawful use.
@jrhuddlesAs I wrote back in March, this case raises significant concerns around government power and the First Amendment that could extend well beyond any particular company as well as beyond just the AI industry. This ruling recognizes similar concerns https://www.cato.org/blog/anthropic-lawsuit-raises-serious-questions-government-power-first-amendment-rights
@CharlieBull0ckIt's been a while since I looked at this Anthropic-DoW case, but I'm reading through the SJ order and I keep going "oh that's right they did do that." Unbelievable stuff. Underrated highlight was when DoW just never did the statutorily required discussion of less intrusive alternative means. Not even a little bit, not even an effort. They had no reason not to do it, there was nothing stopping them, it would've taken four seconds, and they had like 50 chances. Nope, nothing. At one point I half believed that DoW was trying to lose the case, on purpose, so that they could look tough without actually harming defense procurement.
