Sacks Warns US AI Rules Will Not Slow Global Development

In a pair of posts on X, David Sacks argued that a Chinese model called Kimi K3 taking the top spot on Frontend Code Arena shows how quickly foreign AI systems can close the gap, and that U.S. efforts to restrict data centers or add new approval layers could leave America behind. In a follow-up post on X, he said he had predicted Chinese models would gain advanced cyber capabilities and argued that "trying to gatekeep models doesn't work."

K3 prompting important talks! Parallel discovery and development is the day-to-day of science. Even if one stops sharing, progress happens. It's hard to see a way that regulating one local context, could affect global development. Constraint fosters creativity; science knows no borders. This is concerning. For the first time, a Chinese model Kimi K3 has taken #1 on the Frontend Code Arena and is scoring at or near the frontier on other benchmarks. Meanwhile America is tying itself in knots: politicians and bureaucrats are banning new data centers, piling on state regulations, and pushing for new federal agencies to pre-approve frontier models. This is how you lose the AI race. The rest of the world won’t play by our rules if we bog ourselves down. Permissionless innovation is how America won the internet and became the technological envy of the world. We can do it again with AI -- while addressing risks in a targeted way -- or we’ll watch our lead evaporate.

This is *exactly* what I predicted would happen. I said Chinese models would have advanced cyber capabilities within a matter of months and the only thing to do about it was to use AI-powered cyberdefense to protect our systems. Trying to gatekeep models doesn’t work.
I get it. But Kimi K3 also tells us that Mythos-level cyber capability is going to be freely downloadable soon. Big news: Kimi-K3 by @Kimi_Moonshot is now #1 in the Frontend Code Arena with 1679 pts, surpassing Claude Fable 5. This is a 17-place jump from Kimi-k2.6 (#18 -> #1). In Frontend, Kimi-K3 ranked #1 in 6 of 7 domains: Brand & Marketing, Reference-Based Design, Data & Analytics, Consumer Product, Simulations, and Content Creation Tools, landing #2 only in Gaming behind Fable 5.
