Nintendo owns the rights to it, Microsoft owns the maker of the game and Sony owns MGM, which licensed the series to Activision. The best case scenario is essentially to set aside their differences and everyone get a cut from the game by making it a multiplatform downloadable. I think the problem Nintendo has with this is that essentially they haven't launched their WiiWare service, and since they pretty much have final say as to whether it happens or not they decided to put the brakes on the whole thing. I think the only way this will fly is if Nintendo gets a cut of every copy of this game made, whether it's on the 360 or PS3.

You're forgetting one thing. MGM owns the rights to the movies, and Activision has the rights for the video game.
