Yes if we spend that much on something we should be able to do as we please with it but if you read the terms and conditions you will see that technically, like with software, you don't really own the device at all. All you really own is a license that says you are allowed to use this device provided you don't modify or reverse engineer it. What we do is illegal, plain and simple. Any modder or person who has their console modded should realize that. If they are caught there will be repercussions for breaking the terms of the license. I'm not saying don't mod your consoles though, thats totally up to you however if you do and get banned you have no right to complain.

Here's a few things that scratch my head, and I'd love to see some end results.
#1. Banned users were xbox live users, I don't know what percent were gold/silver but I subscribed, paid 8.65 a month after tax and bought lots of things off live, I tallied it up last night, over 250 / yr I spent on xbla/addons.
Did that give me any right to mod my console/pirate some games, hell no. But I'm wondering how much revenue MS has gambled on banning all those consoles, that is live subs per year vs re buying a new console.
#2. Corrupting HDD and disable features. Random saves were disabled and streaming has been disabled. I can't disable avi/xvid/divx anymore from a network drive, it tells me it requires xbox live, and I'm not alone. Also if you installed a game to the HD that has been disabled, and random saves were corrupted.
Why? What was the point, now if I do buy a console I can't cheap out and buy an arcade and put my HDD into the new console. Again, I'd like to see the argument on #1, about the live revenue loss.
#3. Did they not consider if they banned all these people and they truly believe people will go out and buy a new console and be 'legit' why wouldn't they go PS3. That's what I'm doing. If I have to be legit, and I do, I am going PS3. 299 and I get a Hard Drive, it does Blu Ray and streams more files than 360, also I just can't pinpoint a 360 Exclusive anymore that makes it worth mentioning.
#4. Due to the ban I can now pirate games and play them before street if I want, I just lose online. That's what many people feel now, I never played a pirated game online (I own retail of Madden 10, GTA IV, Halo 3, Halo 3 ODST, Borderlands), the only pirated games I owned were Dragon Age/ Assassins Creed I, and the last few Guitar Heroes all of which I didn't play online.
So yes, I get why they did it, but they've given me a real wake up call in other ways, I dont need the 360, and I didn't need Live, MS has just cut me off even though I never got around to do it. Now PSN will get my money for arcade games, etc.

It's the EULA for the Xbox Live service. The xbox still works after its been banned (they don't remote detonate the console), you just can't get on Xbox Live, which clearly states modded Xboxes will be banned.

Banned Xboxs flood online marketplaces

Hundreds of Xboxs have appeared on online marketplaces such as eBay and Craigslist in the wake of the mass Xbox live bans.
Over the past week Microsoft has banned nearly one million users from the online gaming service after finding that they had modified their consoles to play pirated games.
Since the ban is connected to the console rather than a gamer's online account, many modified Xboxs have appeared online being sold by banned users.
eBay has issued a warning to users on its website to be wary of buying consoles in the wake of Microsoft's move.
In a post on the website's guide section, it said: 'If you are looking to buy an Xbox 360 on eBay in the near future, ask the seller if it has been banned from Xbox Live and be sure to pay by PayPal in case they lie. If you do get a banned console, start a PayPal claim.'

I bought the Xbox when it first came out, dropping $399.00 of hard-earned-cash.
The damn thing broke 4 freeking times, and I had to buy extra all the HD, Wifi, wireless card, controller, AND Pay for the network,
AND I could not play DVDs half the time, AND the damn thing was loud as hell and could heat my whole house.
Basically, I'm tired of all the Microsoft BS.
Had no issues with my PS3, and all I ever need comes right out of the box, and the Network is excellent!

You can do whatever you want with the hardware, but if the software gets modified or bypassed then they have a right to deny you.

Stop correlating modded consoles to cheaters, anyone who modded to cheat in online fps on a console has severe issues, severe issues. It's one thing to download a aim bot for PC, its another to go out and intentionally mod your console with hardware with the only intent to cheat in an online game.

They have the right to deny that service to anyone, and it's pretty fair to say that most people who modify their consoles do it to pirate games. Microsoft has every right to refuse service to people who steal their games. If they bricked the xbox's so they couldn't be used at all, that would be ***** up. As it is though, Microsoft is in the right.

I don't know if I explained that well. Imagine that you created your own home-built wireless protocol instead of using one of the standard protocols. So basically you're filling the air with messages that no other device can interpret. Then you copyright that protocol. Then you start making devices that use the protocol. Then someone figures out your protocol and makes their own device that uses it. That's stealing, because you did not give him permission to use the protocol that you created.

Personally I think the Xbox 360 has the better game library and that's why I stick with it, if I want media I'll use a PC.
