On March 29, the complaint became public after Garzón, who had been assigned the case, sent it to the prosecutor's office for review, a step seen by many familiar with the court as a sign that the judge will soon agree to investigate the case. "It's still a bit early," says Almudena Bernabeu, international attorney with the San Francisco–based Center for Justice and Accountability, which has brought claims before the National Court on behalf of victims of human-rights abuse in Guatemala and El Salvador. "But it's a great step."

This is what we did in Europe in the 70's and 80's against RAF, Action Directe, Brigate Rossi etc. The military was just used as a tool to perform operative actions while the responsibility for the ant-terror were law enforcement. It didn't take many years to clean it up and it has never surfaced again.

As long as they stay inside USA, they probably have not much to fear unless Spain decides to use the good old US method called "rendition" and go in and pick them up and then move them to Spain. He was then trapped in Chile till he died a few years later.
Bush would not be arrested, but would not risk travel abroad. The warrant would certainly embolden Americans to file suits against Bush as happened to Pinochet in Chile.

1.He was the Commander in Chief. His security clearance wouldn't allow him to be within a half mile of another prisoner.
