The evidence against Willingham all came from a pseudo-scientific, "gut"-based interpretation of the burn marks on the inside of the house. The real science exonerates him. The death penalty is always wrong and needs to be abolished throughout the US. Yes, it's terrible when the state executes the innocent, but even when they execute the guilty, they make murderers of us all. If you can't produce compelling evidence that "the guy beat his wife and kids," you're guilty of the same dishonesty and chest-thumping as Gov. Perry and you deserve to be buried.

- warlok, on 10/16/2009, -2/+12I support the death penalty, but I've read on the case in the New Yorker, and its clear Williangham was maliciously prosecuted...the State of Texas ignored evidence after the trial that showed the initial fire investigation was wrong, and that the 'evidence' of arson would be created in an accidental fire. Willingham had numerous witnesses that stated they remembered how proud he was of his children. And he never stopped proclaiming his innocence, even when offered life in prison vs. death.
If we are to apply the Death Penalty, it should be for the most heinous of murderers and criminals...for those that are truely unredeemable in our society...a man that kept a girl as his sex slave 18 years comes to mind. "If" is not the basis of our legal system. It's based on evidence and persuasion of a jury beyond reasonable doubt. I don't care if we are 99.99999999999999999999999999999999999999999% sure he is guilty-- there's still a small chance he's not AND besides that, I don't think we should be killing people even when they are guilty. Then add on top of that that staying in a prison cell for 60 years is more punishment than dying painlessly... Sure, money will be spent to keep him in jail, but you have zero chance of executing an innocent man AND with a little bit of reform, we could put our prisoners to work like they do in other places (like Norway).

The main reason I'm against the death penalty is our imperfect system. I'm not ok with executing even one innocent person. I don't think the system does a good job of deciding innocence. Have you ever heard of a prosecutor pushing hard for conviction for reasons other than the true guilt of the offender? I have. They need to make their numbers and look good as well.
So, 'If' there are any doubts, we may want to try and get to the truth. If he did these awful things?
