1. If they have all this evidence, then why would they need to go outside of the courts? Why not use the evidence to charge him with a crime and take his ass to a court of his peers?

To hold someone in prison without charge, indefinitely (!) under a broad interpretation of the president's wartime powers is ridiculous. "When investigators looked through his computer files, they found information on industrial chemical suppliers, sermons by bin Laden, how-to guides for making hydrogen cyanide and information about chemicals labeled "immediately dangerous to life or health," -- that's it? That's the reason to imprison someone and denying him his rights? I wonder what investigators would find if there were to look through your computer and i'm quite sure, whatever it would be, they easily could turn that into a threat and a reason to put you in jail like him. Let alone the fact that this Govt is known for creating a false impression of imminent danger, lying and forging evidence. No charge and probably classified evidence means nobody knows for sure what's on his computer. That's scary and that's why they made a wrong move.

It seems to me, that since the Constitution outlines the Governments responsibilities and holds it, not the citizens, in check -- it would apply EVERYWHERE where the US Government is acting. Also, since the bill of rights does not mention citizens, but people, and restrains the Government from acting upon people a certain way, that it applies to EVERYONE the US Government is acting upon or against.
Also, I would like this administration and its lawyers tried for treason just for suggesting otherwise. Just read up on some hacker cases, such as Kevin Mitnick where then amount of damages were grossly exaggerated, or in the Bernie S. case where Secret Service agents found what they thought to be plastic explosives but later upon further examination turned out to be dental putty. These cases and others have been heavily documented so just search google for more information.
So when the government say they found how-to guides, do we have any reason to assume it was anything more than the anarchists cookbook? A book I think you can buy in some bookstores and is available for free online.
And who hasn't googled "how to build a bomb" or something to that effect at some point or another out of pure curiosity wondering if the internet really does have everything? Are you sure you deleted your internet cache lately?

You know, I'm all for preventative measures and making sure our country is as safe and secure as it can be, but this seems somewhat ludicrous. At least put him through the court system (military or civilian) and don't hold him indefinitely without trial like this. It's entirely possible that this guy was going to carry out some type of attack, but then they should have done some standard sting operation to catch him red-handed if they wanted to charge him as an enemy combattant. To just take random people in the US, find suspicious information in their possession, and then strip them of all their rights, is just an awful precedent to set, as it WILL be abused, and mistakes WILL be made. Slippery slope indeed.

In the past 7+ years, what the Bush Administration has done is engaged in a systematic power grab and claimed full presidential prerogative over the exercise of those powers. Part of the problem seems to be this silly acceptance that we are in a "war on terrorism". That is a pejorative phrase that is too often interpreted literally as if we are legally at war. We aren't. The declaration of war is explicitly empowered to Congress, and they haven't done it.We have a fully functioning police force and court system. The Bill of Rights is pretty clear that it is describing restrictions on the government, so I don't understand the interpretation that somehow those restrictions only apply on US soil.
