This will allow for presentation to the court the new evidence that he is not responsible for the death of the police officer. If the man is innocent he should not be executed. If there is evidence to show his innocence it should be reviewed. I'm not an advocate for the death penalty for any crime. I think other methods of punishment should be found. However, until we can change this method, it is important that we don't execute an innocent person. I am pleased that Mr. Davis is being given time for new evidence to be reviewed. What if he was executed and the evidence showed him to be completely innocent?

There is plenty of causal evidence that poor people are much more likely to commit crimes for a wide variety of reasons. Funny enough, more than 25% of ALL blacks live below the poverty line. These blacks also represent a very large portion of inner city poor, which make up the majority of all "criminals" that you mentioned in your lovely stats. Poor white people tend to live in rural areas, and rural areas tend to experience much less crime than urban areas.
If you examine crime in predominantly white / poor urban neighborhoods, you'll amazingly find nearly identical crime statistics as black / poor urban neighborhoods. Imagine that.

- Urusai, on 10/11/2007, -0/+6The problem is that a majority (as in, two thirds) of capital convictions have gross errors in them, and executing just one innocent person is unconscionable (it's murder then, not merely some clerical or procedural failure). Supreme Court Justice Harry Blackmun came to the conclusion that the procedural problems with the death penalty are intractable, this after the SCOTUS, while he was a member, suspended the death penalty for being applied in a biased manner and later reinstated it with an attempt at safeguards. He concluded that after the reinstatement failed to correct the original problems (poor people and black people being disproportionately sentenced to death), it was time to give up on the whole process.
