Too bad though, I wish the family was allowed to sue the individual school officials that allowed this to happen... Or otherwise cost them their jobs... People like that shouldn't be allowed to go unpunished.
The poor girl has to live with what happened, the rest of her life. For a teenager in school, being strip searched because of childish accusations of other students, and over-reactive staff, is just a horrible experience. - vipero00, on 06/25/2009, -14/+159This is why Republicans are losing credibility. I used to be one but when ***** like this happens and Thomas states "Preservation of order, discipline and safety in public schools is simply not the domain of the Constitution," I lose it. Isn't the Constitution supposed to protect us from unreasonable search and seizure. I would go further than holding them liable in a civil suite. I would say they should be prosecuted for abuse of power under color of authority. These zero tolerance Nazis should be strip searched and sent to jail to tune-up their sensitivity to this issue. Instead SCOTUS has shielded these pricks so that they can continue this abhorrent behavior.

However, regardless of how you or other people coped with that, THIS girl was traumatized. I remember reading her original description of what she was told to do and it turned my stomach. Afterwards she didn't want to return to the school. She changed schools and later dropped out altogether. Clearly these are long term impacts.
That pedo bear is around just for laughs but has genuine relevance here. Think about this whole scenario another way. What if the girl had been forced to undress while she was being closely watched, and then forced to expose herself to someone who was telling her to do it because they were a pedophile?
She said, "They saw everything." - that was how physically exposed she felt. She was only thirteen. She didn't know why they were asking her to behave that way. She clearly didn't know how to refuse their commands, and says she was "wondering why her mother wasn't there". OK. They weren't pedophiles, but in terms of how the girl felt and how she reacted to the physical violation by adults with power over her, there is a huge similarity. This is unlike the shower scenario in that they were close to her and scrutinizing her intimately; in that she did not understand what was going on; and in that she could not continue to be a part of that school afterward.
I have a thirteen year old daughter of my own. If anyone treated her like that I would want them behind bars and regardless of their reasons.

2. If you don't search beyond reasonable measure for over-the-counter Ibuprofen and Naproxen, what justification is there for unreasonable searches for other "street" narcotics;
3."By declaring the search unreasonable in this case, the majority has ‘surrender[ed] control of the American public school system to public school students’ by invalidating school policies that treat all drugs equally and by second-guessing swift disciplinary decisions made by school officials." (i.e., school officials know better, so be quiet and sit down);
4. Work out unreasonable school policies (such as: zero-tolerance drug policies banning asthma inhalers, anti-gang actions suspending students for being in a marching band and anti-weapon policies suspending kids for having a butter knife in their lunch box) via the PTA. There's no need to involve the police or courts when your 13-year-old daughter is forcibly stripped, without parental permission (because Thomas invokes the principal of loco parentis -- in the absence of actual parents, teachers are good enough substitutes) over the possibility, based on one child's claim, that she has a bottle of regular-strength Advil, or Aleve, in her panties.

So you're comparing taking a shower to being forced to a strip search? She was forced against her will and protests that she did nothing wrong. *****, where do I begin? First of all, the girl that accused her was a BIG TIME trouble maker in the school and had a checkered past. The girl forced to strip was a model student with ZERO problems. The mere fact that the school used that *evidence* as the only means to force this girl to strip is beyond understanding. What the ***** were they thinking?
What would I do if I were in the school's position? On the one hand I have a model student. On the other, I have a student who's lied, cheated, got herself into trouble and was anything BUT a model citizen. I damn sure am not ordering a strip search on the word of this person. We all suspect a lot of things. That doesn't mean we get to act on every suspicion. That being said, the problem I have always had with this case is that the search was performed by staff at the school. They had no formal training on searches, and the legality there-of, and no understanding of probable cause. To all of you people who condone the school's actions: do you even know what ibuprofen is? It's the stuff that goes into Advil and Motrin, and one "prescription-strength" pill is same as 2-3 OTC-strength pills.
