BTW, what happened to personal responsibility? If a woman is physically capable of giving consent, why is the man now at risk of punishment? Does he now have to consider if the woman is in the right state of mind while making the decision of whether or not to give consent? That's not really the point though. This law aims to make currently legal consensual sex a crime. It is patronizing to women by saying that they cannot possibly make the right decison after having a few drinks and that the decision to have sex is never the right one.

Further, what level of drunkenness are we talking about? Any alcohol in your system or only falling-down drunk? Take a swig of cough syrup and you count? A glass of wine? Or a six pack? Are we going to have to make sure she's under 0.08 before we get it on? Just how are we going to measure that?
Also, what about if the man is drunk too? If the woman can get drunk enough to not "know what she is doing" and not take responsibility, then certainly men can get that drunk as well. You can't sign a document when you're drunk, why have sex with someone who is drunk and may possibly use your encounter against you? If you don't know the person well enough to trust them, you shouldn't be having drunken sex with them, and this goes both ways. For instance, what if she's passed out? Chances are the next day she won't know whether or not she gave consent - which she couldn't passed out, either. What if she gave consent, but can't remember the next day, and in retrospect wouldn't have either way?
Another thing rape victims often also express after the fact is that they are often so scared, or traumatized, that they just shut off and put their mind somewhere else. This often leads to rape where the woman does not give express consent, but is rendered physically incapable of stopping the situation. Liquor really doesn't help this at all. These are things you should consider before laying someone when they are drunk and you are not. You have a physical and psychological advantage over them.
On the other hand, the law is completely unfair because it doesn't go both ways. Yes, women get raped more than men. It's just a by-product of our culture's depiction of women, power, and responsibility. But men DO get raped, and more often than not, it's because he's in a position where he can be overcome.. aka liquored up. And men experience these same exact things, and are equally -if not more- traumatized, because they often have fewer people who can empathize with them, feel alone in their situation, and don't have the law or government resources on their side when seeking conviction or therapy.
