Scalia Believes Torture is Not Cruel and Unusual. Or Does He
endpoliticsasusual.com — Justice Scalia said torture was not cruel and unusual punishment under the 8th Amendment. I guess he got amnesia and forgot the opinion in which he joined, saying: "Many things ... water torture ... electric shock ... cause agony. A prisoner who alleges that prison officials tortured him has alleged a [cruel and unusual punishment]."

- geneikillua, on 05/14/2008, -0/+1His point which the OP seems unable to comprehend is not that torture is not cruel and unusual, but that it is not punishment. This distinction is important and is why Scalia is a judge and DPolitico spends his days on Digg.
