smh.com.au — Sydney Morning Herald Consumer Affairs Journalist Kelly Bourke questions over $200,000 Home Owners Warranty claim paid to Senator Coonan and changes to government legislation. A spokesman for Royal & Sun Alliance said at the time it was "very rare" for claimants to be awarded the maximum amount....

- builda, on 06/09/2008, -0/+1Apparently Joe Hockey has had a real crack at Kelly Burke in Parliament last week and saying that she got it all wrong.
I think Mr Hockey may be forced to eat humble pie in the very near future.
From my reading of the article and discussions with ASIC and the ACCC it would appear that she was spot on...I would be surprised if the SMH let this one go! - bangusmaxus, on 06/09/2008, -0/+1Yeah, you need to cut through all the fog of war and all the finger pointing and get to the root.
Who was responsible for the changing of the law back then that changed the home owners warranty product from a first resort consumer protected retail product to a last resort wholesale product - thus removing consumer protection provisions? I'm sure I read something about a ten point plan which was "fantastic" for the industry and consumers!!!
IWhy don't they just dump it and save everyone the hundreds of millions of dollars spent each year on this mandatory "junk" insurance? Tasmania dumped it the other month and the Queensland system doesn't seem to have the same problems as NSW consumers are having with the Beechwood Homes collapse. The grapevine has it there is also a big Victorian builder on the ropes - I wonder what will happen if they fall also over?
The whole thing stinks and there now appears enough awareness that the days of the last resort home owners warranty rort may soon be over. I then hope all those builders and consumers who have sufferred at no fault of their own go after a mass class action - bound to be a hungry legal firm out there interested in taking that one on. - builda, on 06/16/2008, -0/+0The vultures are circling - make no mistake.
This insurance is underpinned by Deeds of Indemnity that builders are forced to sign and these are likely illegal and unenforceable according to a WA district court judge. That matter is awaiting trial as we speak. The NSW Government know that they are in trouble here as they have supported this product from day one.
